Hey all!
Searched to forums and had a hard time finding the answer maybe someone can help me out.

Bought a 9mm cx4, wondering if it will accept the beretta 96 40 cal mags without modifying it?

any help will do!!
 
wont the 40 cal mags take 13 rounds? and because the mag is made for a .40 its legal to put the 13rnds of 9mm in it? I could be compleatly 100% wrong , but I thought I read that somewhere . Again I could be 100% wrong .

No pistol magazine can legally take more than 10 rounds.

Basically the only gun that can take more than 10 rounds are rimfire.

5. Magazines for semiautomatic handguns which contain more than ten (10) rounds of a different calibre

Magazines designed to contain centrefire cartridges and designed or manufactured for use in a semiautomatic handgun, are limited to 10 cartridges. The capacity is measured by the kind of cartridge the magazine was designed to contain. In some cases the magazine will be capable of containing more than 10 rounds of a different caliber; however that is not relevant in the determination of the maximum permitted capacity.

Example:
Heckler and Koch P7 pistol chambered for 9mm Luger caliber:
The magazine designed for the 40 S&W calibre variant of the pistol will hold 13 cartridges of 9mm Luger calibre and function in the 9mm Luger calibre P7 pistol. This is permissible as the maximum permitted capacity of the 40 S&W calibre magazine must be measured by the number of 40 S&W calibre cartridges it is capable of holding, which is 10 such cartridges in the case of the HK P7 pistol magazine.

Since the storm is a rifle would it not fall under the "lar pistol mag" idea like the AR-15's?

TOTALLY incorrect. Read and understand the rules / regs in the Firearms Act prior to making (incorrect) sweeping assumptions.

The Storm is a rifle that takes a mag designed for a pistol which is ten rounds. (They were initially supplied with a 10rnd mag marked "CX4 Storm" which had to be returned to dealers and exchanged for 10rnd mags marked for the 92FS pistol because the RCMP ruled them as prohib devices: 10rnd semi-auto rifle mag: centerfire rifle mags are limited to 5rnds as per the FA).

Now if you use 96 mags instead of 92 mags and can squeeze an extra round or two of 9mm in the .40 cal mag then so be it. As per the bulletin the capacity is limited to the ammo the mag was DESIGNED to hold. The 96 mag tops out at 10rnds of .40 S&W which is what it was designed for. The fact that it can hold 10+ rnds of 9mm is of no consequence as it is a .40S&W mag. If were to hold 10+ rnds of .40S&W then it would be a prohib device. Silly, stupid, illogical whatever... it is what it is...for now :D

It's funny - the instructor actually told our class about the 40 cal loophole in the ATT course I took. Pretty sure it wasn't listed in any of the textbooks though...
