Bushnell Elite 3-10x 40mm vs. Legend UltraHD 3-9x 40mm

Given that the Bushnell Elite is $40 more and doesn't have parallax adjustment, is the Bushnell Legend UltraHD (with parallax adjustment from 20 yards to infinity) the better buy?

Between the two, which would you choose?
 
Parallax is less common/critical on scopes below 10x

As I understand it, the legend ultra HD is optically close to the elite brand, but mechanically the elite the better scope. The elite also has rain gaurd which is a big plus for hunting in foul weather. If the time ever comes that you want to upgrade your scope, the elite would still hold a good portion of its value and the Legend Ultra HD will just be a used bushnell. In fact I would look at used elites first. I see 1 one the EE for 160 shipped (3-9), and I see a bunch that are SPF, the good deals go quickly.
 
If this scope is going on a rimfire or precision varmint rifle, then maybe the parallax adjustment might have some benefit. It you are planning on using this on a typical all-around centerfire hunting gun, then I think the parallax adjustment is nothing but a PITA, a hindrance that will never help you but might screw you up at the wrong moment.
 
According to their website, the Lengend Ultra HD comes with Rainguard as well

But given that parallax on their rifles is usually set at 100m, at ranges beyond 100m, would parallax not become more of an issue?
Would it not be worthwhile to have if the feature was included at no additional cost?

I bought a 4.5-14x44 Legend HD about 2 weeks ago. Looks nice, optics appear okay ...... BUT: when it comes to a MADE IN CHINA, it was returned.......yeah, I suppose I am somewhat anal when it comes to Chinese built stuff !

I can understand your concern, but doesn't Bushnell's 100% satisfaction, money back guarantee, ease your concerns regarding Chinese quality control issues?
