Buying firearms with undisclosed damage

I recently bought a used firearm from a big store in Quebec that had serious damage that was not visible from the picture.They did not disclose this damage and as I did not fire the gun or use it,I simply put it in the safe.
Now 5 months later I discover the firearm is unsafe to fire from undisclosed mechanical damage. Seller says too bad. Sound fair to you? Londero sports
Arc Inter was the seller. A word to the wise is all I am giving.
 
What model of firearm and what is the undisclosed mechanical damage?

Is it possible the seller took this used gun in on trade, did not fire the gun or use it, simply put it up for sale, did not discover any undisclosed mechanical damage...?

Buyer be ware!!!! and what, you didn't check it out until 5 months later...how would they know that you didn't cause the damage in the 5 months since they sold it to you!! Buying anything used without seeing it first is always taking a chance.
 
I've bought a couple of guns with that kind of damage, which I didn't discover until I removed the barreled action from the stock. In both cases the damage would not have made the gun unshootable or unsafe, and in both cases the dealer stepped right up and took the gun back with no questions asked. I am confident that they were unaware of the problems when the guns were sold...both guns looked in excellent+ condition, and the damage was difficult to see during a casual inspection. For the record, the dealers were Williams' Arms and Epps, both very upstanding outfits.

This is an excellent reason NOT to buy a gun that you will have no chance to fire for an extended period. In these instances I was back in the shop within a few days of the original purchase. In your case, months later, with no idea of what to expect from these guys or if you have any previous history with them, this is a tougher call...

I hope you can work this out. Mentioning this thread during your conversations with them, without being too heavy-handed, might not hurt.
 
Standard transaction stipulates responsibility on buyer and seller. The buyer is responsible to inspect merchandise received, and if there's a problem they must immediately inform the seller. You cannot wait 5 months then check your purchase, and expect to hold the seller liable.

But that doesn't mean that you cannot negotiate a settlement of some type with them. But if they say no, then I think you're screwed.

Based on your story, Londero Sports Arc Inter won't ever get a chance to sell me even a brand new gun with warranty.

Agree. I take every used gun apart totally right away for a good cleaning and inspection. I had one from epps also in the past 6 months. As soon as I took it out of the box the barrel twisted in my hand. It was a shotgun and my daugther would have noticed something was wrong prior to shipping but epps missed it. They agreed to fix it but on my dime for returning it which was 45.00 shipping. Thus since I could do the repairs myself Kevin ordered the parts I needed and I took care of it. Like he said I bought it like minutes after it was posted and just traded the day before. However I assumed they inspect guns taken on trade but I guess not.All worked out in the end.

Sorry, I believe you loose! the vacation time is long over! I always inspect and test fire a gun as soon as it comes into my hands! Granted, a few years can go by, by the time I get around to playing with it full time, but always always an immediate inspection and a few test fire rounds is a must. I think you will have to chalk this one up to have "learned the hard way"!
 
I wish Epps would do a 5 minute inspection, and safety check on their used guns before shipping them out the door. They sold me one where the firing pin would engage if you flicked off the safety.

Didn't ya know, Remington 700s are supposed to work that way!:stirthepot2:

If I'm purchasing a used firearm by mail order, I fully expect a 3 day inspection period to be honored. But that works both ways, and complaining about a defect months after the transaction doesn't really cut it. I expect to pay the shipping for the gun, but if I find a serious deal breaking defect that the seller missed, the return shipping should be on him.
 
Show us some pictures of your damaged gun.I have a bit of trouble believing these kinds of stories on the posters first post.

Ever deal with the seller/dealer. If you did you may believe the poster as i do from my one and only experience.:mad:Not saying he should not have inspected the firearm when he got it just that there are many dealers out there that do no inspection on used firearms they sell.So buyer beware.

.....and by that you mean that wise buyers inspect and report defects in a timely fashion?

As for "fair", any fair-minded person would have rejected your claim due to the extended period of time that had elapsed. What seems "unfair" in your post is that it seems intended to try to harm the reputation of the vendor, otherwise, you could have simply posed the question without naming names (of course the CGN "old biddies" would have demanded a name, but they're easy enough to ignore).
 
Sadly, the long wait hurts your case. Business' are flooded with false claims. Many have firm rules about time limits for this reason. I'm sure you are not one of them. But honest folks get burned by the liars and thieves out there.

I bought two guns used and sight unseen and have decided to no longer sell or buy remotely. Epps and a fine gentleman from Chatham treated me fine. I received better than described. I do find the private deals on EE better simply because of the reporting system. The killer for me is shipping costs and then the massive headache of warranty for Canadians.

I notice on gun forums guys will get a dog shooter and talk of selling it down the road. Yet every gun for sale is a MOA shooter fortunately.
 
Too bad. You should have looked closer when you received it 5 months ago and it's hard to fault the seller for that. If the seller refuses to help now you'll just have to live with it. Next time you'll know better, hopefully.

He actually went off to another public site and started a similar thread to bash Londero-Arc Inter. While I understand he's disappointed, I think his expectations are out-of-line with reality. As someone else said, hopefully he takes this as a learning experience.

What he really wants is to hurt the business. Misery loves company, and I guess the more he hurts their reputation the better he'll feel, and he can do all this while remaining anonymous.
 
I think when you buy used guns its a roll of the dice. I recently bought 2 from Epps myself, the first exceeded expectations and the second was far worse then I expected.I guess in the end I came out even. I'm not bashing Epps, I love that store, I have bought more from them then any other store.

Shoudl buy a used gun from Londero and say that we did it because of this thread. Or would that be mean to the OP?
