Import into Canada and export from the US are not the same.

When Midway and Zeiss-USA got savaged with huge fines, it was not because they were exporting military scopes without permits. They were exporting telescopic sights.
There are, no doubt, US sellers who are ignorant of US law, or who are prepared to ignore it, in the interest of making a buck.
There are Canadians who are prepared to have controlled goods sent to a US accomodation address, and then do their own exporting, either by mail, or in person.
Doesn't make things legal.
