Caesar Guerini Tempio 28 Gauge firing pin question

Evening gang,

I just picked up this used Ceasar Guerini Tempio Light in 28 Gauge and received it tonight from a shop out on the east coast. When I opened the gun up it had the cocking lever pushed to the side as if you had just opened the action not abnormal but not ideal from what I've been told over the years. The thing I am wondering about is my top barrel firing pin, it is staying stuck in a protruded/fired position after dry firing the gun.

I can press it back in to the retracted position with my thumb or a wooden spoon handle. Re-cocking the gun and dry firing again and the upper pin stays in the fired/protruded position as pictured below.

My question is, is this normal or perhaps something not right here. I plan to call Guerini in the morning to ask them about it but thought I would poll the audience here tonight as well.

Not sure about the pin protruding but I have had that with some of my over unders(Beretta & Rizzini) after firing them off with snap caps and then disassembling to put away in the take down cases as in your picture. It was never of concern as it didn’t interfere with disassembly/reassembly and the guns functioned perfectly. As for your top lever sitting farther right of centre than you feel it should be. As long as the gun locks up properly it should not be of concern. The locking lug is made tapered and to fit the locking channel in the monobloc. As it wears through use the lever will come more towards centre. Check to see if the lock channel in the monobloc is clean. On my 101 pigeon grade a single flake of unburned powder pressed in there will often cause my top lever to sit farther right even though the gun is still locked up tight. I use a toothbrush and a bit of solvent to keep the channel and locking lug clean or sometimes just a can of compressed air to give it a quick clean out in the field. And though it’s of an entirely different design the top lever on my TM1 Perazzi sits around the 4:30 position right of centre after having had a new locking block installed. It will probably take 150,000 rounds before its back to the 6 o’clock position, more than I’ll likely be able to put through it in my remaining days.

I shot a Summit Trap for about 18 months, and now shoot a Maxum Impact Sporting. Neither did this.

There should be a firing pin spring which retracts the firing pin.

Does the pin move back easily when pushed?

I would pull the stock and flush the action well, directing a lot of spray into the firing pin channel from the front. It doesn't take much to gum these up.
 
Thanks for the replies gang, to be clear the locking lever sitting to the right wasn't a concern. The concern was when I opened up the package from the dealer the locking lever had been moved to the right to disassemble the gun for shipping and just left in that position and not released via the button in the lower portion of the breach.

The pin will move back in but it takes some force to do so. I would normally just pull it apart and clean it up with some brake cleaner followed by some lubricant in the right spots but I just received it from the dealer in this condition and don't want to go tearing into it and void any warranty they have against it. It was a used gun and advertised as being in Very Good condition, the risk of buying online I suppose.

Plan to call the dealer and Guerini today to get their take on it and how they want to address it. The Guerini warranty and reputation for good service provide some level of re-assurance guess we will see how it goes.
 
I wouldnt worry too much about how the lever was left when the gun was taken apart. That wouldn't weaken the spring if left in that position if it was just done when it was shipped to you. Usually that may cause an issue if it was always done and for prolonged periods of time. Nothing I would lose sleep over unless something was actually wrong

As for the firing pin, does is also happen if you change the order of which barrel fires first? It doesnt seem right...if that pin is stuck in that position and is stiff to push in, you could run the risk of a shell being fired when the action is slammed shut.
 
When you push the pin back in, does it spring out again?
The Tempio Light has spring loaded rebounding pins so the pin is jamming ahead and not returning to the rearward position for some reason. It shouldn't take any force at all to push it back into the breech face so maybe it sounds as if something is jamming it.
 
With CG gun the opening lever stays in the right when you take it apart. Cg manual tell you how to relate the tension on the spring which you should do when store the gun taken apart.. out of my head on your last pic you should press on that black square while holding the lever right than release the lever .
