To whom it may concern,
I would like clarification on a technical issue regarding magazine capacity for a semi-auto shotgun. The model is a Benelli M4. I spoke with one of your technicians earlier and would like a more formal response via email regarding this question.
The law states that a magazine designed for a semi-automatic firearm can only have a maximum limit of five cartridges of the type that the firearm was designed to use. So in this case the Benelli M4 is chambered for 3" 12 gauge shells and according to your data, has a factory limit of four cartridges.
My question is am I legally allowed to extend the magazine to allow for five 3" shells? The technician I spoke to was adamant that I was allowed to do this regardless of how many shorter shells could actually fit into the magazine. She said that the capacity applies to the 3" shells only. So as long as I cannot load a sixth 3" shell in the magazine, I would be in compliance with the law.
If someone could take a few minutes to respond and confirm this information that would be great. Thank you for your time and I look forward to your response on this issue.

Yes the limit is 5 for a long gun in semi-automatic action and centre fire cartridge. Refer to the Regulation
http://laws-lois.justice.gc.ca/eng/regulations/SOR-98-462/page-2.html#h-4 .(PART 4 PROHIBITED DEVICES).
We never count the one in the chamber and we always use the longer cartridge even if you can use shorter shells (2 2/3", 2 1/2", etc...).
