I had a link previously posted in another thread.
A couple of years ago Zeiss in the US was fined $10,000 for sending 10 rifle scopes to Canada without export permits.
Midway USA was fined $222,000 for exporting about 250 scopes without export permits. That is why Midway doesn't export anymore.

Most E-Bay sellers do not bother with the permits, and therefore can end up in a world of trouble with the U.S. authorities.Your scope can be seized on the U.S. side (and you will lose it and your money), and your name can be flagged by the U.S .authorities which may bring closer scrutiny on future purchases.
If you are posting about U.S .purchases on CGN, the policy is that both countries import/export laws MUST be followed, or don't both posting.

I recently ordered a Leupold brand new from a UK supplier who calledme to explain that the delay was on the US side, his are definetly new in the box, still wrapped but purchased in the US and privately shipped. The supply delay was due to his order and mine not coinciding. If it had been about permits then the scopes surely would have attracted import duties and the price would have gone up. Maybe the yanks hate Maple syrup flavour bacon after all and this is their revenge?
The point is that your friend's US supplier is violating US federal law, either intentionally or unwittingly.
Collection of taxes on the Canadian side is irrelevant.
If eBay spots the sale, they will report it. The shipper is liable to receive punitive fines, at the very least.
If they get caught, it is anyone's guess if your friend will find his name flagged in the US.

Over the past year, I've bought 4 different scopes off eBay (2 red dots and 2 mil-dot illuminated reticle scopes). All 4 of them were shipped from hong kong, and all 4 of them are ripoffs/counterfiets of some kind, but who cares? Shipping was REALLY fast (about 1 week, maybe 2) considering they came from hong kong, and all but one of them has held up to my abuse so far (the 12-24x40mm has recoil damage).
If the seller is based in the US, they may or may not ship to you depending on their knowledge of import/export laws. As skby mentioned, scopes require an export permit from the US, and therefore the seller will be violating US law by shipping a scope to you. Your best bet is to email the seller and ask what shipping will cost to canada, then you'll know for sure what's going on.
IMHO, I'd find another similar scope from a seller based in hong kong, to avoid the legalities involved with US auctions. They usually list the item as a buy-it-now, at a lower price than most other auctions on eBay, but recover their costs in shipping & handling charges (which can often be more than the price of the item!!). Just shop around carefully, do the math and convert currencies back & forth to figure out if it's worth it or not. Hope that helps!

I've bought 3 scope off ebay. 2 were fine and I still use them, 1 was crap and the cross hairs actually broke off inside the scope. All were very cheap in price, about 25%-30% of retail value and all came from within Canada. I would by scopes off ebay again.

The problem is not for the Cdn. buyer, apart from the possibility of loss of the shipment if it is detected. It is the US seller who is taking a huge risk. Export of controlled items without an export licence is a federal offence, and penalties which have been imposed are severe.
Should a Cdn. take advantage of the ignorance of a US seller who is unaware of US law, and if things go bad just walk away? Or do business with an exporter who is prepared to violate US federal law?
And if a person is involved with the illegal export of goods from the US, is it a good idea to be bragging about the savings on a public forum?
