I am wondering what is the legality around selling fake leupold scopes.

At the last few gun shows I observed a guy selling fake scopes without informing potential customers about his counterfeit product.

The scopes look like Leupolds, come in the same box as Leupold scopes, but the optics resemble low grade Bushnell only.
Price for a 5-14 x 40 is $250.00.

You might have seen him, he was at the Orangeville show as well.

Next time I see him at any show I will have to speak to the organizer.

buyer beware if the price is too good to be true it usually is
as for legality full disclosure would be appropriate to any potential buyer

Section 52 of the Act is a criminal provision. It prohibits knowingly or recklessly making, or permitting the making of, a representation to the public, in any form whatever, that is false or misleading in a material respect. Under this provision, it is not necessary to demonstrate that any person was deceived or misled; that any member of the public to whom the representation was made was within Canada; or that the representation was made in a place to which the public had access.

How do you know 'for sure" they are fake? How can you prove it/Can you prove it to the guy? Did you ask the guy if they were real? To see what he says?

When I saw the scopes I realized the price can't be right, so I looked closer at the scopes (I am a Leupold fanboy), I told the guy they are fake, he knew already, and he replied that's why they sell for 250 bucks.
He shrugged his shoulders and walked away when I told him that he must disclose to the public that his merchandise is faked.

Some of the stuff looks so good you can't even tell

I'm very leary of buying any optics at gun shows unless a reputable dealer is selling them

There is one here in the exchange forum. Been two times since I noticed the moderator and my thread is dissapearing.
I'm done trying warning the guys. I'm pissed.
Be careful with a guy , is nickname is a number: 2x10. And followed by one of the best finland bullet maker who are also the inventor of the 338...
Btw I made a thread from the suggestion of a moderator and he just deleted it.
Now we have to worry about the mods hiding potential fraud! Way to go gunnutz

I believe the thread you started was in the EE which is likely why it was deleted. I obviously couldn't respond so I PM'd you some info on counterfeit leupolds.

The trick to finding if things are on the shady side is to take a picture of the optic with model and serial number,,, then email the info to Leopold head office.

They will confirm if it's fake,,, most likely they would contact the consumer affairs to find out who might be behind this.

Kinda like getting the ball rolling
