Hunter shooting at a moose

A Lindsay man has been fined $1,500 for shooting at a moose from a motorboat.

The incident occurred on the Whitefish River, south of Timmins

Jason Lober pleaded guilty in the Ontario Court of Justice in Timmins to discharging a firearm from a motorboat.

He was also placed on probation for two years. A firearm, a boat and two outboard motors were seized during the investigation and will be returned once the fine has been paid.

Court heard that on Oct. 8, Ministry of Natural Resources conservation officers conducted an enforcement blitz on the Whitefish River on what was the opening day of moose season for gun-armed hunters. Conservation officers had received several public complaints of illegal hunting activity in the area.

Officers watched Lober as he fired six shots at a moose while standing in his motorboat. When Lober stopped shooting he was arrested by the officers.

Justice of the Peace Jean Marie Blier heard the case in Timmins provincial court on Nov. 24.

If the motor is in the water, then yes it is illegal to shoot from a motor boat. If he had been in a canoe, or a boat with the motor out of the water and all forward motion stopped, he would have been fine.
He was likely moving when he spotted the moose and just shut the motor off to shoot.

Yup ... It is illegal to hunt, pursue, harass, etc.. ANY game from a motorized vehicle, vessel or aircraft here in Ontario. All propulsion & movement due to the engines must be stopped prior to shooting.

Most guys using powerboats for duck & goose hunting raise the engine and drop the anchor befoer they even think about loading their gun.

Myself, i prefer a canoe and the smaller rivers and sneaking up on them :)
 
Interesting, seems like similar rules just a little more involved. If I remember correctly. In Manitoba, forward motion must be stopped as well but the motor doesn't need to be pulled out.

Sounds like this guy was cruising around looking for a moose, when he saw one, through the rule book into the water instead of his anchor and started blasting away. What an idiot!

In the eyes of the law it's no different that shooting from your truck or ATV. There is a special exemption that a disabled hunter can get, but otherwise totally illegal. As a matter of fact it's illegal to even have a loaded firearm in a boat that's underway, let alone discharge one.

The only exception for discharge in a (stopped) boat is waterfowl.

Loaded firearms in hunting areas

17. (1) A person who is in an area usually inhabited by wildlife or who is on the way to or from an area usually inhabited by wildlife shall not,

(a) have a loaded firearm in or on a conveyance or discharge a firearm from a conveyance, except if,

(i) the conveyance is a boat that is not a motorboat, or

(ii) the conveyance is a motorboat and the person is hunting migratory birds in accordance with the regulations under the Migratory Birds Convention Act, 1994 (Canada);

motorboat” means a boat with a motor that is attached to the boat and that is capable of being used as a means of propulsion, and includes any floating object being towed by a motorboat;

I too was thinking this while reading the article (I think there is some info missing) poor reporting which is typical of the printed media to keep the public in the dark about what actually took place.

The guy was found guilty of something while hunting and all I can say is"What a fool"

The rules in BC state ''means a boat, canoe or yacht
powered by electric, gasoline, oil, steam or
other mechanical means, but does not include
a boat powered manually nor a boat with an

I have read somewhere that even mentions the propulsion of the boat going forward ...advancing on game while hunting as well...

That is nothing new in that area. There seems to be a much different attitude towards legality of hunting across much of the North end of the province from what I experienced in my years spent living up there. I can remember the Mayor of Iroquois Falls riding in the back of an aquaintances truck on top of a dead moose with the tag in his hand just in case he had to tag it fast if the MNR came along. That way if he got it home without having to tag it he would still have a tag to get another moose. I believe he is now the MP or MPP for the whole Timmins/James Bay Riding or something like that.

Boat stopped and the animal has to be standing on bottom I believe or it is considered swimming and cannot be shot.

I was always told that the animals chest could not be touching the water. Not sure if that's what was written at one point, or if it was "common sense" to avoid possible charges.
 
I thought the law was the animal cannot be harassed or shot while swimming as it is not fair chase. Therefor had to be standing while in water and not swimming.
I may stand corrected.
