I was gong by what the manufacturer says about it. It's probably classified differently here in Canada. But the Henry folks consider it a lever action pistol.
Yes in the USA it is sold as a "pistol", and should you ever decide to put a full length stock on it you are committing a felony (unless you do the proper paperwork for a SBR). Much like the AR-15's that can be configured as a pistol or rifle, it creates problems if you do things wrong.
