From 7 yards, no it won't.If you miss hitting the head just the concussion from the shock waves of the bullet on a high powered rifle will either knock them out or kill them if the bullet passes close enough.
Perfectly legal here.Be aware that using a high powered rifle on upland game birds may not be legal in your area even with handloaded reduced grouse loads.
