Given the choice between the two, it would be the Marlin. The Marlins are by no means, lightweights but the Henry's I have handled were heavier. I understand Marlin has gotten their QC issues taken care of so make sure you get the newest production model.
Just my two cents.

The Marlin is stainless with laminate, the Henry is only plated steel with hardwood stocks.

Henry makes a beautiful rifle, but if you are after an "all weather", the Marlin gets my vote. The 24" barrel on the Marlin would help with velocity, and the pistol grip on the Marlin is nicer to shoot if you are planning on scoping it IMO.

Plus the Marlin has the CBS....... (flame away)

Henry all the way. Not only its a better gun, customer services is outstanding. Try to get parts or talk to someone at Rem/Marlin to get your gun fixed and see what happens.
