Sounds a little shady on the part of the shop also. If something happened accidentally or not why not just be honest and correct the situation? Now this is going to be a whole long drawn out ordeal between the OP and Henry and the vendor. Doesn't smell quite right.

Yeah...sort of what I'm thinking. You (OP) has spent the money, you should be enjoying a gun now...not involved in a circular discussion between the you, the shop, and Henry. The shop owes you a gun in the condition agreed upon, or, your $ back. Nothing in between. In fact, if the shop wants to get "into it" with Henry (on what grounds, I'm not sure) then I'd simply say to them "listen, I hope you manage to sort this out with them but in the meantime...I'd like my $ back until you do".

That...or...if you honestly trust them 110% and think they're making this issue a priority~sit tight for a day or two and see if a NEW rifle might be on it's way.
 
I would not buy that rifle in that condition.

How much is this thing costing you? If over 100 bucks I would be RUNNING away.

They railed you for sure. If you agreed to purchasing a new rifle I would ask them to order a new one in as that is NOT new.

If anything I would ask for money back, if they will not give it back. I would settle for a minimum of store credit and ask them to order a new rifle.

Again if buying used... Id buy something else.

The issue has been resolved in full. I went back to the store, and got a full refund - apparently, one of the employees at the store had left the rifle (muzzle end) underneath a leaking bottle of acid toilet cleaner, that somehow leaked all over the muzzle end. The owner was as pissed as I was, and said that the careless employee who created this situation, basically has purchased the gun which is now completely written off, or maybe re-blueing is in order.

To make a long story short, the refund has given me the opportunity to locate the identical rifle, BRAND NEW, from a different vendor, for even less than the price of the original used one. ??? I think the pricing on the used/written off Henry was ridiculously high for what that rifle is - even if it is a "Henry". Thank god.

Sometimes crappy situations work out for the best in the end! Sounds like even after the agrivarion you came out ahead in the end. Congrats!

That's a very strange story henry22...maybe one of the strangest I've ever heard. However, you've ended-up in a good place now that the dust has settled, so that's all that matters. As for dealing with that vendor~sounds like they handled it OK, but I'm not sure I'd do a layaway thing with them again.
 
I'm am very happy with the outcome, and I LOVE this little shootin' rifle. I haven't been able to shoot it yet, but very soon, before the snow comes.
