How do you measure shotgun length with folding stock?

If a shotgun has a folding stock, how does one measure the length to ensure that it meets with the requirements of the minimum length law? Does one measure it with the stock extended or the stock folded?
 
Thank you. That's too bad - I was hoping that they measured it extended.

Now, can someone tell me what the shortest barrel is that will keep an HP9 or a Remington 870 with a folding stock (Grizzly type) legal?

Will a 14 inch barrel on the HP9 or 870 and a folding stock keep the folded length over 26 inches? I haven't bought the shotgun yet so can't measure it myself.

It might be possible with a 14.5 inch barrel on an 870 using the Mesa high-tube stock adapter, coupled at the end with an ar15 buffer tube folding adapter (Choate makes one or Ace), it will be very close though...

A top or side folder with a 18.5" barrel will put you around 27". Depending on model (Mossberg is a bit shorter than Remington).
Shortest barreled NR shotgun would be a 12" barrel with a collapsible stock. Around 29".

"prohibited firearm"
(b) a firearm that is adapted from a rifle or shotgun, whether by sawing, cutting or any other alteration, and that, as so adapted,
(i) is less than 660 mm in length, or
(ii) is 660 mm or greater in length and has a barrel less than 457 mm in length

"restricted firearm"
(b) a firearm that
(i) is not a prohibited firearm,
(ii) has a barrel less than 470 mm in length, and
(iii) is capable of discharging centre-fire ammunition in a semi-automatic manner,
(c) a firearm that is designed or adapted to be fired when reduced to a length of less than 660 mm by folding, telescoping or otherwise, or
(d) a firearm of any other kind that is prescribed to be a restricted firearm;

As far as I can tell the Remington 870 with 18.5" barrel and top-folding stock in the picture is well over 26" (660mm) and classified as Non-Restricted by our silly system.
 
14" barrel with a birds head style grip is really close to 26". It will just depend on which specific folder you use. 18.5" barrel puts you well over 26.
