How soon can the handgun be shipped?

Here's a hypothetical purchase situation:
Private transaction, seller and buyer reside in different provinces. Payment for a handgun is sent and received. Seller calls the CFO and initiates registration transfer, forwards the reference number to the buyer. Buyer calls the CFO and completes the transfer.

Now at this point, as I understand, seller is still a registered owner of the above handgun. Shipping will take up to two weeks and the transfer should take less. Can the seller ship the gun now if he so choses (so when it arrives the transfer is done and the gun is registered to the buyer) or must he wait until the new transfer /registration numbers are issued before he can legally ship it?

What do The Regulations say about such issue?

Can only be shipped after the transfer is completed. You need a STATT to take it to the post office, they normally dont give this to you until the transfer is complete.

Your LTATT does NOT cover you taking it to the post office.
 
Nope. When it comes to restricted firearms (ie handguns) nothing goes anywhere until your provincial CFO approves the transfer. Once they approve, they contact the seller telling them its okay to release the firearm, and issue a ATT if necessary.

Haven't heard of it being done any other way.
 
Why would you ship before the transfer has been approved?
I wouldn't wait for the notification to be mailed but I would wait till I got confirmation from the CFC that the transfer has been approved and completed.
 
I've just gone through this type of transaction. I purchased a pistol from EE.
Seller originated the transfer, contacted me with the reference number, I completed the transfer with CFC and they passed the file to the province. The province approved it in a day, when I called to check on it they told me it was done and the seller could verify OK to ship by calling them.

They also provide the seller with a hard copy of the transfer but it is not necessary to have before shipping. Along as the transfer has been completed and approved your good to go.
 
You don't ship a restricted until the transfer is approved by the CFO. You are also supposed to obtain a temporary ATT in order to take the firearm to the post office for shipping...
 
You cannot ship until the transfer is "approved" by the CFO for the province the buyer resides in. It does not matter that the transfer has been "initated & completed" it still has to be "approved"

If that is ON, expect a 3 week delay (maybe more). If that is a western Province, expect the approval to take 1 day, sometimes SAME day.

I have no experience with Eastern provinces.
 
Last time I did it, shipping to AB, it took 2 days to get transfer approved and they gave me full day to take package to Post Office.

There are ways around this like if they pick up locally then you dont have to goto the post office at all... or you travel to a gunsmith who ships it for you... ;)
 
If the transaction is taking place between two members of the same shooting club, then the purchaser may take it home today even before any transfer has been initiated. No additional ATT is needed because both have ATTs from home to the club, so if the exchange happened at the club and the buyer is given the registration paper then technically he is only borrowing the hand gun until the transfer is complete.

That is the only simple solution I can think of that could be done immediately.

You cannot do that with restricted - only non-restricted

Your ATT only allowes you to transport restricted that are registered to your residence (at least in Ontario). Therefore you would be illegally in possesion.

I believe you are mistaken, because you can lend your gun to your friend (assuming he has an RPAL and ATT) if this happens at the club. He has an ATT to transport restricted and prohibited firearms back and forth home/club. The registration certificate does not have your name on it (after you cut it out) and your ATT does not name each of your firearms.

I do not see why it would be illegal. :confused:

That is the shady way of doing things.... what if a day later the buddies CFO came back and denied him the transfer? He now has your restricted firearm and is not approved to own it.

I would only do this if he was a very close friend and you 'knew' the transfer would be approved.
 
In quebec, ATT specify you can transport all firearm for which a valid certificat has been issued in your name. So, you cannot rent/borrow/whatever a firearm you dont own without a specific ATT. By the way, depending on the term of your ATT, being in posession of the "seller" handgun could land you in jail.

is this true? coz when i talked to cfo awhile ago they told me the buyer can ship because the firearm is allready on my name. they even gave me my certificate number on the phone.

AFAIK the firearm is good to ship once the cfc/cfo has confirmed and given the go ahead. I've never waited for the piece of paper to show up. Get the statt and off it goes....

thats what cfc told me too, but the seller said he needs the copy of the transfer first.

i allready have my certificate number too.

i just saw this on their website http://www.rcmp-grc.gc.ca/cfp-pcaf/fs-fd/sell-vendre-eng.htm

"The new owner can take physical possession of the firearm as soon as the CFP transfer agent provides them with their new registration certificate number. The registration certificate will then be mailed to the new owner within a few weeks."
