So my normal goose hunting area has been turned into a bird sanctuary for a couple specicies of migratory song birds. The landowner and I used to be neighbors and he has no issue with me hunting on his lands) Does anybody know if it would be illegal for me to deer and goose as a result of the sanctuary. I always make sure to dot my eyes and cross my tees when hunting their as I commonly get a visit from law enforcement when goose hunting as one of the distant neighbors doesn't like hunters.

If the area is posted "No Hunting," then no one can hunt there, not even the landowner. Or so I've been told. Otherwise, how formal is the status of this sanctuary? Does the owner get a tax break for making it a sanctuary? Does he have documents laying out what he's agreed to? Are there any signs up at all? Are there people there birdwatching and stuff? Anyway, for a final answer to your particular question I think you'll have to call the local game warden or whoever enforces such things where you are.

That's how the law in NB is too. Posted No Hunting means, no hunting by anyone period.

That isn't the law in the Alberta or Saskatchewan. Out here, the landowner can post the land however he chooses , and he can still hunt on the land, or give permission for anyone else to hunt on the land. Unfortunately many people that come here, don't bother to learn our laws, before trying to tell us what the laws are. I have told more than a few people where to go, when they tried to tell me that I couldn't hunt on land that was posted "no hunting or trespassing", even though I had permission from the landowner.

You need to contact the MNR. It the land is posted "No Hunting" by the MNR or some other government agency, then I would expect that to apply to everybody, including the landowner.

If the landowner has his property posted "No Hunting", then he is still perfectly within his rights to hunt on his own land, or give permission to others to do so.

There is no posting. My understanding what s that a local solar farm is leasing the land for 20 years to offset the destruction of the birds original migration grounds. Imohp its really stupid and I have yet to see one of these song birds around. I think I will contact the mnr though to be on the safe side.

1: Stupid stupid stupid political correctness, quite on a par with all of the Left's eco beliefs. The real songbird habitat will remain wiped out and the solar farm should burn in hell for this sort of hypocrisy.

2: Not posted, I don't think you have a problem at all, if only because the lease holders clearly don't have a problem with birds being killed.
