Importing an Eotech

Hi,

I'm going to be in the States and am planning to return with an Eotech that I am getting from my cousin.

I'm assuming there is no issue with bringing this back since it is not a controlled part.

Is it better to mail it back to myself.

Any advice would be appreciated.

To confirm.

An optic requires and export permit to be taken out of the US and it is illegal for a Canadian to bring back an optic from the US.

Correct ?

Since Jan 1St the US State Department has crack down on anything military related. ACOG, Aimpoints and EOtech to name a few. AR parts are also included. Some of the AR I have see come into the country are now in post ban form and that is also due to the US State Department. So to answer your question yes it is illegal. If you were caught with it they might just take it away if they are nice. If they want to be dicks about it they will charge you.

When EO Tech was purchased by L3 Communications a couple of years back the US Govt. made any Canadian dealer who was importing their optics apply in the most invasive applications we have ever seen. Because L3 is a huge US military supplier in much more than just small arms optics we had to be screened personaly by the US govt. including our complete education and job history. The process took the better part of a year to complete just for a couple of holo sites that are essentially a hardened Bushnell holosight. We still can't get the 553 as the tan color and quick release mounts make it somehow that much more dangerous and not for the consumption of the Canadian civilian population. Phil.
 
I just had an Eotech mailed to me from a private citizen from the US. It was stopped by customs (albeit for a lengthly period- 3 weeks), and was subsequently cleared without incident. I argued my point and they agreed. I was told optics are not on the prohibited items list.

Stopped by CBSA? The offence wasn't bringing it in to Canada, it was exporting it from the US. No Canadian law was broken, an American law was. CBSA is Canadian therefore do not enforce US law. US Customs would have apprehended the unit, and considered charges.

try ebay, and find one from HK or Europe (slim chance tho). i sure you wont have a problem with US customs there...

Won't be long before US govt put pressure on ebay to stop any loop hole.
 
A while back, I unexpectedly was forced to spend a very interesting and educational evening at a US border crossing because I bought more than $ 100 US $$ in gun parts at an American gunshow, and tried to drive over the border back to Canuckistan with them. I was making no attempt to hide these bits ... I even had a list with me, all ready to declare them to Can Customs ... just like I'd done several times before with absolutely no hassle.

The pleasantness included being locked in cell, bounced off the wall a few times by two VERY big US Border Patrol agents, while a third hovered near the only door out, right hand twitching spasmodically just above his pistol grip. All the while several other agents of righteousness were stripping down my old Toyata Van to the bare metal [ literally ... they cut open the upholstery and crow barred off a lot of the interior panels ] looking for nefariousness.

My crime? I had a money belt [ with actual US $100 bills in it ... which apparently US BP does not like much ] and a bag full of gun parts including a few laser sights, a couple of plastic VPG, a folding stock, and a pneumatic buffer ... all of them absolutely/positively gun parts
BECAUSE -
they potentially could be attached to a firearm. Even a 6X48 gun screw meets this definition, if somewhere, some gun takes that thread and pitch.

None of these items individually would have been a problem, because none of these items individually was worth more than $ 100 US. However, in total they WERE worth more than $ 100 US ... which apparently the US border patrol has absolutely no sense of humor about.

It took six months to finally come to resolution on this ... they kept my gun parts, and put me on the US border Patrol #### list. Which makes for some interesting conversations at the border.

I went down to the US last month to import a motorcycle, and nobody looked at me funny this time, so maybe I finally fell of their list. But on our vacation to Mexico last year, my Lady was less than impressed with the extra attention me [ and HER luggage ] got from the agents of righteousness, while changing planes at US airports.

You have been warned ... no item that can be potentially attached to a firearm is exempt, and $100 in total IS the limit.

Don't you just feel so much safer now??

Absatively true.

Right after I was tossed so thoroughly by US BP, they sent me on my merry way North ... right into the not so eager arms of the Canuckistanny Customs agents. These Canuckleheads were a bit sheepish, because I had BTDT with them several times before, always declaring my gun bits, and paying duty on it, with absolutely no hassle from them. I think they were somewhat embarrassed because I had all my previous Can Custom receipts with me, and also because I had asked one of the agents about US gun laws before I started doing these trips.

The RCMP uniforms who also showed up to add in to the festive event by tossing me a third and final time were so much more plolite [ typical Canadians, Ehhh ] and kept saying things like " We are sure this all a mistake, but ..."

In any case, none of this meant a snoball in Hell in the big picture. Two weeks later my new Canickistan renewal papers showed up, and a month later my US CCW papers showed up, so neither the RCMP nor the FBI think too badly of me.

But customs ... US Customs AND Can Customs ... seem to be literally unaccounatable. No telling what they might do to me next?

so whats the deal with bringing guns into the US? I know all about 6nia. But say your AR has an aimpoint on it or an ACOG? Can you bring these things with you into the US? Will you get hassled bringing them out with you again? Or do these laws only reference newly bought stuff?
 
Best Bet - got to a CBSA office and get them documented
-- I have had a trouble with a Kevlar helmet once -- never a problem (US side) with parts going back out.

Temporary import are ok -- but the onus is on you to prove they are imported into the US...
