Is it Illegal to have Hi-Cap mags that are not pinned to 10?

just wondering if it is illegal to possess hi cap mags as long as no one with any authority ever sees these loaded passed 10 rounds??? my brother purchased a glock from a non supporting gunnutz dealer and it was shipped with 2 unpinned 17 round mags! do we go ahead and pin these ourselves? or can we just take it to the range and only load up to 10 rounds into each mag? would their be any criminal issues involved with leaving these the way they are as long as we never loaded them over 10 rounds?
 
A magazine that is not restricted by "permanent" mechanical means to 10 rounds (semi auto handguns) or 5 rounds (semi auto rifles) is considered a prohibited device. If you're found in possession of one you will be charged for possession of a prohibited device.

There are a few exceptions to the above rule; Lee-Enfields are allowed 10 rounds, M1 Garands are allowed 8 rounds, and AR-15s are allowed 10 if you buy LAR-15 magazines (LAR-15 = semi-auto handgun based on the AR-15, the mags work in regular AR-15s and it's legal to use them in that way).

If it is a .22 rifle magazine it is legal, there is no restriction on magazine capacity. If the magazines are for a semi-automatic, centerfire rifle the magazines are prohibited(illegal). If those magazines are for a handgun they are prohibited(illegal). If you are in possession of these magazines I would suggest pinning them. It is no use spending time in prison and have your guns taken away just for a few more bullets in a magazine.
 
I really enjoy your "as long as no one with any authority ever sees these" concept. That's kinda like saying "Is Theft/Murder/Speeding/Whatever still illegal if no one catches me doing it?"
 
Speaking from a law-enforcement perspective and past observations, yes, you would be in possession of a prohibited device, and would likely suffer confiscation of all your firearms-related paraphernalia and potential jail time. That's if you were a law-abiding citizen with a clean record. Now if you were a lifetime career criminal, and had used those prohibited devices in the commision of a crime, the police would do the same things to you and you would be charged with the same things, but you would most likely go free in a few hours with our sincerest apologies for taking time out of your busy schedule. Either way, you would never see those mags again, and it would probably be years before you got any of your other property back, if at all. True, you might be able to go to the range for decades without arousing any suspicion or coming into contact with any LEOs, but then you could get caught with those things tomorrow and have years of legal battles ahead. Nobody needs those hassles. Get your mags pinned. Cheapest insurance there is.

It is apparent that politicians have NEVER discovered the function of that little button on the side of the frame. fire 10 rounds, push button, drop mag, insert another 10 round magazine.;)
 
What makes me laugh is the fact that the politicians haven't realized that all the criminals need to do is spend 3 seconds with a drill and the magazine then becomes capable of evildoing. But then, most politicians aren't burdened with things like logic.

had the pin fall out of my sks. i admit, i did give it some thought but then panic set in; started to think of what i have gained as opposed to what i could lose....off i went to the weld shop. not worth it bud. get em pinned.
 
pin it, cause if someone at the range notices, that alone may be a one way ticket to not come back....

And while I don't think you need to name the dealer here for us to see, you really should phone them and advise them of the error, they need to get their act together if they want to keep the licence.

It would be great to have hi-cap mags, but you can't justify it with "well that is the way they sold it to me".
 
Ok here we go again.... d:h:

the enfield is only on the list because there were semi-auto varients that used the regular enfield mags.... therefore any enfield mag was designed to be used in a semiauto firearm and a prohibited device... never mind that the only semi auto enfields your ever going to see are in the pattern room, at the Royal Armouries in Leeds, and I think there are a few copies in Museums in Australia.

The mag exemption has nothing to do with the enfield being a bolt action rifle.
 
hmm in Edmonton I ran into folks who have unpinned magazine. (Even the range gun carbine magazine was unpinned with 10 rounds -USC)
It really depends on whether the provinical government bother to catch it. I'm not sure if this true but in Alberta, you can shoot auto, without people catching you as provinical gov't refused to do anything bout it.
