Is it Illegal to have Hi-Cap mags that are not pinned to 10?

just wondering if it is illegal to possess hi cap mags as long as no one with any authority ever sees these loaded passed 10 rounds??? my brother purchased a glock from a non supporting gunnutz dealer and it was shipped with 2 unpinned 17 round mags! do we go ahead and pin these ourselves? or can we just take it to the range and only load up to 10 rounds into each mag? would their be any criminal issues involved with leaving these the way they are as long as we never loaded them over 10 rounds?

just pin them yourself and be done with it!
 
thanks for the info everyone my brother has now disassembled for the mags for the time being..........i called the dealer and he stated "this is the way he received them and it is up to me to pin them" what a crock of s**t he has now caused more work by having to go out and buy a rivit gun and rivits!!!!! what a joke! my brother is pissed!!!! will ask for compensation if we every order from him again!!!! which i doubt will ever happen after that a**hole comment!

Technically by the law you have 30 days to do it!

I think posting this thread has done plenty of damage already to all of us than the act of having a few full capacity magazines.

I don't care to know who the dealer is either. Your Glock came from the States packaged with real magazines. How hard is it to pop a rivet into a Glock mag? The hole is already there. Pin 'em and move on. If not, send the whole package back for a refund and buy elsewhere.

I'll even send you the right sized rivet, GRATIS. Better yet ... how much you want for them? PM me.

contacted the dealer again today and he stated that he will trade me for pinned 10/17 round mags at my expense for shipping both ways!!!! not even worth it!, iam located in B.C. and he is in Quebec! he is very firm on this and there is a slight language barrier! so it is what it is! good deal on the glock so ill eat the cost on the rivit gun and we'll leave it at that! mags are currently disassembled
cause i dont want no future headaches i just thought maybe you could have the hi caps just as long as they were not loaded but i guess not!!!!! i apprecaite all the feedback!!!!

Just buy the rivet gun at canadian tire, pin the mags and return the rivet gun....if you can't borrow one from someone.

The light side of 17/10 pinned mags (yes we all know it sucks to have to have pinned mags oh Canada....) will be easier on the thumbs when loading.

Prohibited devices can only be imported for the purpose of sale to police, military and other agencies with licenses to possess them. Many dealers do possess various prohibited items for this purpose. However, you can't import prohibited mags for the purpose of pinning them and selling them as normal.

I believe some dealers have a license to do that.

You can have the parts to make a 17 round magazine, its not a prohibited device until they are put back together. Disassemble till you get it figured out.

I wouldn't count on that... some guy in BC was convicted of possession of a prohib device for having full cap AR mag bodies last year.
 
A magazine that is not restricted by "permanent" mechanical means to 10 rounds (semi auto handguns) or 5 rounds (semi auto rifles) is considered a prohibited device. If you're found in possession of one you will be charged for possession of a prohibited device.

There are a few exceptions to the above rule; Lee-Enfields are allowed 10 rounds, M1 Garands are allowed 8 rounds, and AR-15s are allowed 10 if you buy LAR-15 magazines (LAR-15 = semi-auto handgun based on the AR-15, the mags work in regular AR-15s and it's legal to use them in that way).

Lee-Enfield is not a semi-auto, so you can have 50 round mag for it if you wish.

I've charged people with much, much worse things (persons crimes) and the result is normally a fine or ____ days in custody in default (if you cant pay the fine/choose not to)(first offence keep in mind).

This is Canada, not the U.S...it's never "you get caught you go to jail." ...there's so many more factors. Ever hear of a probation orders, or community service?

What are the odds of receiving a ban on owning or possessing a firearm after a conviction for this?

If convicted, you'll more than likely get a 10yr weapons prohibition which is the general abstain period. This includes minor offences like hi-cap mags, being found with a prohib weapon, or serious persons crimes.

If convicted of an offence *involving* a firearm however (pointing a firearm, hostage taking w/ firearm, unlawful discharge), it's possible to get a lifetime weapon prohibition depending on the severity.

It's ultimately up to the Judge and the circumstances of the offence. If any of you have legal questions regarding firearms feel free to PM me.
 
To correct my last post, you won't necessarily get a 10yr weapons prohib for having a hi-cap mag..it's all about circumstances. where you get caught with it, etc. If you have it at the range (ie: not committing any other offences), you could get by.

There's no point in chancing it. But if you do, hopefully you deal with a Member who uses discretion ;).
