Is it legal to keep a Side Saddle loaded?

The Rcmp states that non restricted firearms are stored and transported unloaded.

Is a Side Saddle that is attached to the firearm now considered part of it, and therefore if it's loaded so is the gun? Or is the siddel saddle a completely different thing that can remain loaded.
 
I believe "loaded" constitutes "ammunition loaded into a magazine like device in which the firearm feeds directly from", or something along those lines.
That being said, I'm no lawyer and if you're seriously concerned, email your CFO. Make them earn their wages.

The law also defines what unloaded is:

unloaded, in respect of a firearm, means that any propellant, projectile or cartridge that can be discharged from the firearm is not contained in the breech or firing chamber of the firearm nor in the cartridge magazine attached to or inserted into the firearm. (non chargée)

CFO can not and will not interpret the law, all they can legally and will do is direct you to the act

Really? My experience has been the exact opposite. Years ago I asked many questions and everytime I was provided with an answer. Granted things have likely changed.

I would go with the legal definition..the CFO's office has been know to be not the best source for accurate definitions of what you can or can't do
 
I've gone through a few CO road checks during hunting season here in BC and I have never had an issue with having ammo in a side saddle. Of course, the guns are unloaded (I even put trigger locks on them, not that I need to, but the CO's always like to see them and makes it easier to get moving along quickly). Shawn has the correct answer up above there.
 
Ammo in a side saddle doesn't make it loaded. The thing to watch is, ammo is supposed to be stored separately. So although its not loaded its sure as hell not separate for the purpose of storage.
 
If the side-saddle is loaded;

The shotgun (with the ammo in the side-saddle) should be locked in a gun cabinet.

Actually, stored separately from OR with the firearms. So storing ammo in the safe is legal. Just can't store it IN the gun in any way. ON or around the gun is fine.
 
I thought someone posted about this topic a while ago and provided a link to the FA act or RCMP about ammunition"touching or mounted on" a firearm could be prosecuted?

I was always under the impression that this was kosher, but many others seem tp disagree.

No. The ammunition cannot be in the side saddle if its not locked up in a safe or cabinet.
 
In Ontario during hunting season side saddles could not be loaded, ammo could not be in contact with the firearm. This was awhile back but to be safe I'd check out the hunting regs in your area

I was stopped two times last season and those 4 CO's (2 each time) had zero issue with the side saddle holding 6 shells. Unloaded, so it's good to go.

You were given false information. I had a discussion with a Policeman on Saturday AM at first light while he checked our licenses and property permission slips. The "side saddle" on my rifle had 6 shells in it when I uncased it right in front of him. He asked (?) if that was considered loaded to which I replied "No,to be considered loaded,there had to be ammo in the chamber or in the magazine." He texted his Sergeant who told him the same thing. It's clearly written in the Ontario FWCAct and in The Firearms Act. It's difficult to make a mistake..
