Tonight i shot the biggest doe i have ever seen... Perfect 175yd shot... She was right beside a cedar rail fence and when i shot her she limped over the fence and fell on the other side... Next i no my brother and I are there having a smoke giving the doe 10 mins to lay down before we go in to get her and this woman comes up to us, She asks how we are I replied good and you, She says good so what did you just shoot, I reply a deer... She says where did it go,I said it crossed over the cedar fence and we are waiting to go get her... She says O ic so you just left her to go suffer.. I am like no i just want her to lay down so i am not pushing her deep into the cedars I said i gonna give her 5 more mins and go in... She says NOPE thats her property the deer dropped on and its hers now... I'm like OK.. So then i proceed to apologize that the deer fell on her property... She says every year someone hunts her property,, I told her and she bloody well new i wasnt huntiong her property the deer crossed the fence after it was hit... So she says show me where the deer is.. We go over the fence and there it is laying down almost dead... She says now get oughtta here.. I am thinking back to what she said about me leaving it to suffer but clearly it was still alive and she was telling us to get lost... So she didnt have a gun or anything so i am like well mam can i atlest put it oughtta its misery.. She said yes so i did. Then she promptly kicked us off her property and left the deer there to rott! I find out from authoritys there is nothing i can do.. its hers to let do with what she wants. So this activist would rather see a deer left to rott then made use of feeding my family... Made me sick to my stomach..

As far as I know, you have the right to retrieve a downed animal. If she made a stink, the fish cops should back you on that.

You never have the right to trespass. You have the right to call a F&W officer and let them deal with it.
 
Apparently as i was told by Law enforcment they cannot force her to give up the deer..... Or force her to do anything with it and I actually thought of sneaking in when dark and stealing it but was told i would be charged with theft and tresspasing... I am dumbfounded at this point!

And yes ski911 she was trespassing to tell me not to!!..

I have been told all the F&W wardon can do is try and convince her to give it up wich isnt happening.. She apparently did this to someone last year to... They stole the deer back but she had there plate number and charged them!
 
I don't think it was the doe that needed to be shot. So, who is she to trespass to say you can't? I definitely would of made that point to her.

I was field shooting this morning for geese and mallards. Ended up coasting 2 geese into a neighbouring pond. After the hunt, I went to the farmer and explained our situation. He was more than open to letting us come onto his land and retrieve the geese. Too bad not everyone could be like him.

This being the case,the woman should have to either let the hunters take the deer,or tag the deer herself and dress it out before it spoils.By doing neither,would the woman not be in violation of this regulation?
 
Did you punch out your tag, or did she. dosent she have to have a valid license and tag to be in posession, or does she just leave it. Sorry to hear that, it sure sucks.

Theft? She doesn't have any property rights in that deer, IMO. The Crown owns the deer, and when you legally shoot it and cancel your tag then ownership passes to you.

I am way too lazy to do the legal research now, but I'd call the CO. Tell them that she took your deer. If they go out there and she has the deer, she had also better have a canceled tag.

An example would be you are riding your quad, hit a bump and fall off. The quad rolls onto private property. By what rule or law would your ownership transfer to the property owner?
