Killing raccoons in the city - Toronto

We're renting a unit, in a home, where a raccoon has ripped up the roof (damage caused) and taken residence in the garage attic. Now, I'd like to help the landlady deal with the pest, especially since my fiance is afraid of using the patio and also because they are damaging the garage roof. The landlady's nice, so I'd like to help her out with some good info. Based on the following link, it looks like the landlady is allowed to kill the animal:

The law
You don’t need a permit to scare away, capture or kill most wild animals, if the animal is causing damage to your property.

You do need to follow certain rules.

Special rules apply to:

endangered/threatened species
moose
white-tailed deer
American elk
black bear (capturing)
You can also use someone else to remove the animal for you, if they meet certain criteria. This person is considered a “wildlife agent”.

The problem comes from other legislation. In Toronto, you get a $5000 fine if you discharge a 'firearm' (which includes crossbows), so that method of humane dispatch is impossible. Relocating the coon does nothing. Spearing/drowning are not allowed and kill traps may trap some neighbour's cat, so neither of those options would work. I was thinking of garbage bag and CO2 fire extinguisher, once caught in a live trap (she owns one). Would that be permitted, or would it run afoul of animal cruelty laws? I know they routinely do it to lab animals. Thanks for any tips you guys can give me.

P.S. Please note that this is a Toronto suburb, in the day and age of nosy hipsters and smartphones, so I wanna do everything by the book.
 
Live trap then dispose of item when nobody around
Have policy at work that must remove item and let go 50 km from site
Animal is verrry slow if any moving after release. Don’t wanna be caught letting a live one go around here
 
Live trap, then transport where legal to discharge.

That would be several hours of driving with a distressed, disease-carrying animal in the carpeted trunk of my sedan (no need for a truck in Moronto). Since the mother doesn't look like she pupped yet, I'd say now's a good time to trap and kill, if legally possible. Would using the CO2 method get me in legal trouble via animal cruelty laws?

Garbage can (hardware store)

Water from the garden faucet.

If you can't stand to watch it drown, put the lid on the can after you install the racoon/trap combo in the water. Another quiet alternative, is a industrial strength bin liner/garbage bag, and a spray can of ether starter fluid. Trap in the bag, close up as much space as possible, hose some ether in, and go have a coffee with the nice lady.

I have, in times past, used dog kibble with holes drilled through them, and strung like beads on string, as bait.

If it were not for the neighbors critters, I'd just say a bag of cheap dog food, and a jug of antifreeze.

Water would be a bit messy and also most likely run afoul of Ontario's animal cruelty laws. C02 is cheap, done on lab animals, not as messy (just place the cage in a plastic bag, tape it around the nozzle, blast the fire extinguisher, wait a few minutes), I'm not sure if it's legal in case any hipsters report us and also to have the city haul the animal away without getting us in legal trouble.
 
Both of the suggestions you have made are unlawful. Several people have been charged and convicted for drowning raccoons and skunks as they are not water animals and it has been deemed cruelty to them by the courts.(Especially in Toronto). It has always been unlawful to use poison in Ontario on wild animals. CO2 in an enclosed box would work also.

Hire a trapper to take care of the problem as they are considered agents under the Fish and Wildlife Act. Once they are in a cage trap a 220 conibear trap place in a box at the entrance will take care of the raccoon quickly.

Thanks.. Actually I was gonna ask about that option. Would it be legal for the homeowner to do that on their own property or would it have to be a trapper?

CO2 is a no no. Allowed in small rodents. Not is something that size. OSPCA would be all over you and it would be mean.
Live Trap and then Killing could also be concidered illegal. If you trapped them they are no longer damaging your property so you have no reason to kill them.

You are in the City. If anyone finds out you killed anything the Po Po will be knocking at your door.
 
CO2 ? Water ??? whats wrong with a good old tiger torch, you easterners gotta learn to think outside of the box.
