An airgun testing such that at least 1 of the 2 limits is below the limits is not considered a firearm for purposes of sale. For other purposes under the law, such as use in commission of a crime, every airgun or replica is considered a firearm regardless of power/speed.
Considering the new proposed law last Thursday from our illustrious prime minister Justin Castro... *ahem*... Trudeau... It seems I'll have to adjust the above statement. Airsoft, NERF, water pistols, and in fact anything which looks like it was designed to kill people in the shortest amount of time is now illegal. Period.
