Can simply load 5 rounds 🤦‍♂️into an 8 rounder
The OP is not the first person to ask about loading fewer rounds in a Garand. There are ways to internally limit a pingey so it can't take 8 rounds. The Conservation Officer won't care if he ejects 5 rounds from a 8-round "clip" it is still over-capacity according to the game regulations. The judge probably isn't interested in wordplay about patent language either. So, play within the rules and nothing gets complicated.

I have never ordered enbloc clips from overseas before but it seems that they ship internationally and it’s not technically a magazine. You can also see from the pictures how easy the modification is. Meeting hunting regs isn’t the same as pinning magazines to meet the requirements of the firearms act. Think of the plastic rod that comes with a shotgun to drop in the tube and limit to 2+1 for duck/goose hunting then remove it when you’re not hunting.
 
So how do you get around the fact a M1 Garand magazine can hold either a 8 round or smaller En-bloc clip?
We are talking hunting regs and CO's, so they tend to be much more practical than federal law and agents of the state. Make sure you only have 5 round clips on you when hunting and the CO will never bother asking about hypothetical 8 rounders that you have at home.

This is no different than hunting with a semi-auto rifle that takes box mags. If you only have 5 round mags with you they don't care if it can also accept 30 round mags. Or when bird hunting and the only thing limiting your tube mag to 2 rounds is an easily removable plug. As long as the plug is in place when the CO checks then you're fine, even if you could just remove it 5 minutes after he leaves.

John Garand in his 1930 Patent on the Garand rifle even mentioned numerous times (13), that the En-bloc clip is inserted into the rifle magazine!

The key wording is "capable of holding" and a Garand is still "capable" of holding 4,5 or 8 round en-blocks. You can (i have) make an insert that fits inside a Garand that wont interfere with operation that only allows a 4 shot enbloc to fit inside...sort of mimicking the shotgun plugs that have been legal for use for decades....But and a big BUT , Im still not sure it circumvents the "capable" word in a courtroom...That being said I will be hunting mine this fall with the makeshift "plug".

The reality is that they didn't hunt legally, they just weren't challenged over it ...yet...but if it ever does come up as a "test case" i'm betting on the courtroom version of what is legal will trump your version.
 
Or why not just phone the CO and get the information from the horses mouth? They are the ones who you will run into and judge you in the field.
And a judge would be the one to define the outcome…….

Unless said enforcement official gives you it in writing it is useless, lots of incorrect and misleading information gets given out by field officials, and the egg on your face would be stating Officer XYZ said it works this way, and then when Officer XYZ gets questioned his reply would be I have no recollection of such a conversation.

Or my buddy that had a detachable curved maged SKS got by deer hunting with nothing but a 2 cent pop rivet in the mag?

Here’s my advice……. Buy a 5 round pingy or 3 and carry only those while hunting, most fish cops know jack schitt about different firearms, and wouldn’t know anything beyond what they see.

Heck if ya wanna confuse Mr. Green Jeans have them check the Ruger Number 1 your hunting with, they can’t fathom it has no magazine…

At least somebody else gets it. People have been hunting with box mag fed semi-autos for many decades and this has never been an issue.

As a secondary question, has anyone ever had a CO check mag capacity while hunting? Aside from bird hunting I've never experienced it. My limited contact with CO's has shown they care that your gun is unloaded in/on a vehicle and that you have the appropriate licenses and tags, nothing more.

That is up to your tolerance for risk. The penalties for breaking hunting regs can be pretty severe compared to the level of the offence and it isn't that hard to buy some 5 round clips to be legal.

I have great contempt for government and our numerous retarded laws. I refuse to abide by many of them, but this isn't one I will ignore just to avoid buying a couple 5 round clips.
