What do you get when you mix an armchair hunter with a spear and a dead Ontario black bear?
About $1,000 in fines for hunting big game with a weapon other than a firearm.
The Ministry of Natural Resources reported Thursday that a 44-year-old Chesterfield, Mich., man was found guilty of hunting with a spear under the Fish and Wildlife Conservation Act.
Court heard that a conservation officer found a spear head with dried blood on it during a search last fall of the man‘s vehicle at the Sault Ste. Marie border crossing.
The man admitted to using the spear in Ontario in 2007 to hunt and kill a black bear near Dubreuilville, court was told.
The spear was forfeited to the Crown, the ministry said.
Five Northwestern Ontario residents have been fined more than $10,000 for illegally killing, tagging and possessing a cow moose, the Ministry of Natural Resources reported Thursday.
Accidental shootingproves costly
Three Ear Falls residents, aged 74, 31 and 35, and two Perrault Falls men, aged 37 and 39, were convicted of the illegal hunting activities following a lengthy investigation by Red Lake conservation officers and the Centre of Forensic Sciences in Sault Ste. Marie.
Court heard that the 74-year-old man shot a cow moose in the Windfall Road area in Wildlife Management Unit 5 on Dec. 11, 2007.
When he discovered it was not a bull moose, he left the injured animal in the bush for three days and did not report the accidental shooting to the ministry. He returned to the dying animal with a group of hunters he had assembled.
One of the Perrault Falls men attached his cow moose tag to the animal and all five hunters dressed and extracted it from the kill site and brought the carcass to one of the Ear Falls residents‘ garage, court was told.
The 74-year-old man was fined $4,000 for illegally hunting a cow moose and is prohibited from hunting in Ontario for two years. The 31-year-old was fined $2,500 for illegal possession of a cow moose. He can‘t hunt in Ontario for one year.
The 35-year-old man whose garage was used to hang the moose was fined $750 for illegal possession of a cow moose.
The two Perrault Falls men were each fined $1,500 for assisting in the tagging and removal of the moose, and one of them can‘t hunt in Ontario for one year.
The ministry reminds hunters to immediately report animals shot accidentally.
Sloppy huntersfined $1,800
Three southern Ontario residents have been fined $1,800 for leaving building materials and litter at their moose hunt camp in a conservation reserve north of Sioux Lookout.
The Ministry of Natural Resources said Thursday that the men, aged 42, 72, and 74, from Leamington, Comber and Wheatley were each fined $600 for leaving garbage at a campsite on the Lac Seul Islands Conservation Reserve east of Ear Falls.
Court heard that the men had left building materials and litter at their campsite in Bannatyne Bay following an October 2007 moose hunting trip.
The men had previously been warned by a conservation officer to clean up their campsite, court was told.
The ministry reminds hunters that it is illegal to leave hunt camp materials and garbage at a campsite.
 
Must be something in the water around here this past year. There was a story a few days ago about a fellow that killed a deer by running it over with his boat.

A Wisconsin man’s unorthodox hunting technique, which had him combine a firearm and powerboat engine propeller to take down a deer, earned him 10 days in jail.

Justice of the Peace Roger McCraw sentenced Philip Borofka, 56, of Marshfield, Wis., to 10 days in jail in addition to more than $10,000 in fines. The fines and jail time are the result of Borofka’s hunting methods from a powerboat, which included him running over a swimming deer before and after trying to shoot at it.

The court heard that Borofka was part of a six-man hunting party, which forced a deer into the water from an island near the Cochrane Island area of Lake of the Woods.

Borofka shot at the swimming deer from a powerboat. After missing, he ran over it with his powerboat. The propeller of the boat’s engine mortally wounded the deer.

Borofka again tried shooting at the deer from the boat.

Borofka has also been suspended from hunting in Ontario for seven years. The boat, owned by a third party, and Borofka’s firearms will be returned after the fines are paid for.

Why, if you have a licence to hunt, would it be against the law, to hunt with a spear? I think the hunting regulations only deal with what you can hunt with, not with what you can not! Please someone tell me, can I, with a valid hunting permit, hunt with a spear?

I suspect the law doesn;'t say you can't, but neither does it say you can ..... Pretty sure it has to do with regs being in place for firearms, bows, and crossbows, but no other method specified in the regs.

Where does it say you can't use a spear to take a Black Bear? (mind you, this is Morontario)
 
When you actually stop to think about it..

The thought of seeing hunting with the oldest and most widely weapon used for hunting in mankind history, being prohibited..it's kinda puzzling Ô_o!
 
I think it's because the regs say what you can use to hunt animals, and if it isn't on the list then it isn't allowed.

Personally, if you want to go after 200-800lbs of angry land predator with a stick and a piece of sharp metal on the end, be my guest.
 
Hunting regs tend to work the other way around, if it isn't mentionned as being allowed, it's prohibited.

I wonder if the bear hunter didn't have a license and that was the problem? After all, if something isn't prohibited, then it's allowed, right? Or am I dreaming in technicolor here in Nazitario?
 
I say if you have the balls to tackle a bear with a spear more power to you.

I'm curious what the reasoning would be behind it not being allowed other than the rules don't say it's permitted?
 
We can't have people hunting with spears. If we allow that we'll have to allow rocks as well. Game populations could be decimated by rock throwing hunters. ;)

It would take some cojones to kill a bear with a spear. Maybe there is still some predatory instinct left in the human race after all.
 
I've got to take my hat off to anyone who will hunt a bear with a spear. However after talking about hunting with a DRN guy. The law only allows for certain wepons to be used for harvesting game. Anything else is illegal no exceptions. But I can't see why a spear couldn't be classed as a arrow. If he could prove his abiltiy to take game with it like the bow hunting course, Why not. He should have checked it out before killing a bear, could have saved him a lot of money.
