Well, after a lot of leg work I finally got this rifle. The original owner said it was in very good shape and had 200 rounds or less... well I say B.S. it is absolutely like brand new and if it has 20 rounds through it I will eat my shorts. It even still has the little "inspected by So and So" tag on the fore stock.

Came with all paper work and scope mount (never used), offset hammer spur and carrying case and original box.

Only problem is, I bought it to shoot it, and now that I see it, I am a bit reluctant to shoot it and risk a scratch or something. Stupid, I know, but these rifles are a little hard to find in ultra minty shape (or in any shape)

It is a lot smaller than I expected, Being that the 39a is quite a good size I thought this would be the same with a shorter barrel, but the length of pull is shorter as well.

Fit and finish is AMAZING and is head and shoulders above any rimfire I have seen and handled (not that I have seen them all, but it is really well made).

Shoot the darn thing and enjoy that "new gun smell". Break 'er in with respect but in a way that makes no compromises about what its mission in life is to be.... :D

Are my eyes playing tricks on me? It seems like it has a really short barrel and foregrip compared to the shoulder stock length compared to others.

I'm not sure I have no others to compare it to... it all fits in the little bag nicely.
Barrel is 16.5".

Marlin needs to bring these back....and some stainless 1894 trappers while they are at it!!

That's a great little rifle that you've got there. I've got the next shortest Marlin, the 39M which has a 20" barrel. I believe what you're saying about the fit and finish. Mine is also excellent. I'm sure that you'll really enjoy it. The actions are beautifully smooth and the the accuracy is great from every Marlin 39 I've seen. The nice thing about them, and yours is even more compact, is just how nice they are to carry. If you use it for small game hunting it will quickly become a favourite. Enjoy that rifle and never, ever sell it.
 
Ah... I see the references to it being a short barrel. Good, I don't need new glasses.... YET! :D

I suppose the fear of marking it up is related to how you intended to use it. Certainly if this will be a range toy then there's no reason for it to get marked up for years to come. It lives in the padded case after all doesn't it? And even if it'll be a woods gun for hunting small game with at least a bit of care it'll stay in good shape. Granted if you're used to low hand tossing your old beaters into the back of the truck it'll mean some behavioral re-learning. But there's no reason to impose solitary confinement on it just because it's got a pretty face.

The magazine on mine stays loaded when it is broken down. I've had to break mine down to clear a jam before and the magazine stayed fully loaded. In fact, unless you have a faulty cartridge stop I can't see how the magazine would unload itself.
 
I will double check but I was pretty sure I could see the follower when it was broken down. It never occured to me to try and break it down loaded.
