Metis to defy new hunting restrictions

To understand how the Metis can be 100% aboriginal:

Section 35 of the Constitution Act, 1982 relates to the rights of Aboriginal Peoples of Canada. It states:

35. (1) The existing aboriginal and treaty rights of the aboriginal peoples of Canada are hereby recognized and affirmed.

(2) In this Act, "aboriginal peoples of Canada" includes Indian, Inuit and Metis peoples of Canada. (my emphasis)

(3) For greater certainty, in subsection (1), "treaty rights" includes rights that now exist by way of land claims agreements or may be so acquired.

(4) Notwithstanding any other provision of this Act, the aboriginal and treaty rights referred to in subsection (1) are guaranteed equally to male and female persons.


Ah, yes the constitution, brought to us by the racist, socialist, communist ####stain TRUDEAU. There in lies the problem. You are quoting one of the most racist documents in the free world.
 
I do not like the idea of having a person or a group of people having special privilages. If this is Canada, we are all equal . I want to be able to hunt the same as everyone else. If a group can get away with this, why can not we ?

I know they have rights,traditions,etc. but so do we. When will it all end? God provided game for all to hunt but not overdone.
 
In 1982 when the Constitution Act and Charter were introduced I was in University and at that particular time taking courses in Canadian Human rights and Constitutional Law. The professor I had for the Canadian Human Rights course was undoubtedly the biggest socialist I have ever met. We argued constantly. We did, however, agree that the Constitution Act and Charter would eventually lead to the destruction of Canada because it did extend unequal rights among the populace and promoted or legislated the cultural mosaic. The conservative Constitutional Law professor agreed.

For the record, I am not a lawyer and I am a non-aboriginal. I have fought the IMHA since its inception and met with MLA’s and Ministers to speak on the subject. I found out very early, if you want to be taken seriously, you better know your stuff. You better understand the Constitution Act (that is how Metis are considered Aboriginals), you better understand that there can be limitations to rights, you better understand Powley and Blais and Sparrow and their implications on our current state of affairs.

Unless you plan on taking this fight to the streets, imposing sanctions and/or setting roadblocks you better understand how the system works. Under the current laws of this country (S. 35), Metis are 100% Aboriginal; to suggest otherwise makes one look foolish and does little to advance solutions to the problem that was/is the IMHA.

In forty or fifty years the notion of Aboriginal rights will likely become arbitrary. As there is no blood quantum to claim Metis status, I suspect the majority of Canadians will be able to claim Aboriginal status with far less than 5% Metis blood. I know similar instances exist today. If the Constitution Act and Charter are allowed to remain static, we will have a world of trouble in the near future because there just won’t be enough rights to go around.
 
Are you guys more pi$$ed off about the fact that the native peoples of Canada aren't bound by conventional game laws...or the fact that you are?

Any person's that take a defiant stand against the system will either affect change, or go to jail.

Lets wait and see.
