hey clay shooters, has anyone seen the new form 6 that's supposed to be out for 2014...I am planning to take my trap gun with me to the cardinal centre in june for some service ,but can't find the new form that says you don't need a hunting license or an invite to the club.....thanks...tom

The Form 6NIA has not changed, on Items 13 and 14 put "Not Applicable", since both the Hunting License or Shooting Invitation requirements are no longer applicable. This is due to a US Department of Justice rule change regarding those Non Immigrant Aliens from countries with visa or without visa requirements. The US does not require Canadians to have a visa, thus these two requirements are now gone. The ruling is written in the US Federal Register, Volume 77, Number 110, published June 7, 2012. Google the Federal Register and get a copy for your information. Keep in mind, the Register is written by lawyers and in this case is it what is "not said" that is important. At the end of the section is the pertinent language, that only Non Resident Aliens admitted to the US under a visa are required to have either the Hunting License or Shooting Invitation. Good for us in Canada .....

Have a look at Joe Potosky's forum http://www.losttarget.com/form6 for the latest info on the Form 6 process. I renewed mine this summer and didn't submit a hunting license or invite. Do be advised that some border crossings were going above and beyond the letter of the law and still requiring an invite. It may be worth the $5 for a license or a few minutes of work to get an invite (vs being sent away at the border).

Brad.

I have heard the same info regarding some border crossings. Rarely ran into the issue, but showed them the BATF approved Form 6 with "Not Applicable" entries and US Federal Register info and they were very understanding. To the point that a couple of times the Sargent asked for a copy for reference. The following is the link to the Federal Register info:

http://www.gpo.gov/fdsys/pkg/FR-2012-06-07/pdf/2012-13762.pdf

Page 33630 (top left of page) has the final ruling, § 478.120 Firearms or ammunition imported by or for a nonimmigrant alien. Note that NIA from countries that do not require a visa are exempt from the two requirements.

Got my Form 6 in less than two weeks, two weeks ago. I did not get an hunting license these two past years. Most of the times crossing recently, I was not even sent to secondary to verify the serial numbers. BTW, Travelling through Europe, I don't have to go through this crap! I just drive through the border!
