The question about 223 in a x39 mag is because the mag itself is approved or not, based on the capacity IT WAS DESIGNED FOR. If you happen to fit moe rounds of a different calibre into it, its still legal.

Several pistol mags DESIGNED FOR .40 S&W will hold 13 or 14 9x19 rounds.
All legal.

Like an AR it is the lower that is registered, John at Wolverine is very reluctant at bring in the shorter uppers, simply because he doesn't want to see anyone taking a short upper on none restricted lower out in the woods and get themselves into trouble, that might lead to a reclassification of all XCR.
