Have you tried loading 9mm in the .40SW mag yet, and checked if it will feed properly ?

They probably work.
I know that my 96D Beretta .40 S&W mags do feed in 9mm models. It scared me to death, I spent days at the window watching for the Sûreté du Québec to come and seize my guns...
Seriously, I do hope any authority figure you have to meet with that issue will show some brains. It's probably written .40 S&W on the mag. Use this.
