Non-restricted Transport Before Certificate?

Okay - so I have a question about transportation. I looked through the firearms act and found this - but it's not crystal clear to me:

Unauthorized possession in motor vehicle Generally, 94. (1) Subject to subsections (3) to (5) and section 98, every person commits an offence who is an occupant of a motor vehicle in which the person knows there is a firearm, a prohibited weapon, a restricted weapon, a prohibited device, other than a replica firearm, or any prohibited ammunition, unless
(a) in the case of a firearm,
(i) the person or any other occupant of the motor vehicle is the holder of
(A) an authorization or a licence under which the person or other occupant may possess the firearm and, in the case of a prohibited firearm or a restricted firearm, transport the prohibited firearm or restricted firearm, and
(B) a registration certificate for the firearm,

(ii) the person had reasonable grounds to believe that any other occupant of the motor vehicle was the holder of
(A) an authorization or a licence under which that other occupant may possess the firearm and, in the case of a prohibited firearm or a restricted firearm, transport the prohibited firearm or restricted firearm, and
(B) a registration certificate for the firearm, or
(iii) the person had reasonable grounds to believe that any other occupant of the motor vehicle was a person who could not be convicted of an offence under this Act by reason of sections 117.07 to 117.1 or any other Act of Parliament; and
(b) in the case of a prohibited weapon, a restricted weapon, a prohibited device or any prohibited ammunition,
(i) the person or any other occupant of the motor vehicle is the holder of an authorization or a licence under which the person or other occupant may transport the prohibited weapon, restricted weapon, prohibited device or prohibited ammunition, or
(ii) the person had reasonable grounds to believe that any other occupant of the motor vehicle was
(A) the holder of an authorization or a licence under which the other occupant may transport the prohibited weapon, restricted weapon, prohibited device or prohibited ammunition, or
(B) a person who could not be convicted of an offence under this Act by reason of sections 117.07 to 117.1 or any other Act of Parliament.


Hypothetical situation. You purchase a non-restricted and complete the transfer process. You take possession of the firearm via shipping, etc. You have no certificate but you do have the # from the transfer.

Can the firearm be taken to the range without a certificate? :confused: Or do you have to wait for the certificate to come in?

non restricted yes go ahead to the range, with restricted you have to carry all your paperwork, your ATT and your cret. but with non-restricted some people suggest it, but most don't.
 
To be on the safe side, keep the reference number from the CFC handy until you get your certificate. Same applies with the ATT for restricted, if you haven't received the paperwork yet. This is what I was told by the nice lady on the phone.
 
awndray is bang on(pardon the pun). Your reference #/transfer papers will be more than adequate while waiting for your registration certificate.

The CFO can fax or email you the transfer notice (the same thing you get from a store when you buy a new gun). That will cover you 100% until the actual cert shows up.
 
If my memory serves me correct My instructor told us we were not required to carry our registration papers with us but said it was a good idea (to prevent hassles) from LEO's and CO's... but that doesn't seem to be the case anymore, or am I mixed up?

Your instructor is flat out wrong. See section 117.03, subsection 1 of the Criminal Code:

117.03 (1) Notwithstanding section 117.02, a peace officer who finds

(a) a person in possession of a firearm who fails, on demand, to produce, for inspection by the peace officer, an authorization or a licence under which the person may lawfully possess the firearm and a registration certificate for the firearm, or
(b) a person in possession of a prohibited weapon, a restricted weapon, a prohibited device or any prohibited ammunition who fails, on demand, to produce, for inspection by the peace officer, an authorization or a licence under which the person may lawfully possess it,

may seize the firearm, prohibited weapon, restricted weapon, prohibited device or prohibited ammunition unless its possession by the person in the circumstances in which it is found is authorized by any provision of this Part, or the person is under the direct and immediate supervision of another person who may lawfully possess it.

The relevant parts are bolded. Summary: if you cannot produce your registration certificate upon request, the officer is allowed to seize your gun until you can.

BTW, subsection 2 gives you 14 days to claim your gun by showing your registration certificate, and after those 14 days subsection 3 gives a judge the power to decide whether or not you get your gun back.

Keep your registration certificates with your guns!
 
Your right, I think what he was getting at was they "may" seize your gun although in our area hunting is as common as bike riding, so more than likely it hasn't happened in our area...yet. I have my certs with me today at work so I can copy and laminate them...it's still bullsh*t....

This is why it's good to review the laws every few years, just to make sure your up to snuff....
 
I bought a rifle from a sporting goods store last month and the only thing I got from them at the time was a receipt.So they were supposed to give me papers for the rifle at the store?
First time buying since the late 80s so please excuse the newbness.

They won't have the papers. The transfer number is good enough to act as a reg cert until you receive the actual reg cert in the mail.

A licensed dealer is supposed to be able to print out a temporary registration for you.
 
Don't forget the letter stating that they will be sending you a registration certificate. I just about fell over when I got these for my non-restricted.

Is it really worth the cost of the stamp and the paper to let me know another piece of mail will be coming?

I thought the same thing... i got that letter when i registered my first guns... but the next one i bought they just sent the cert. Maybe they are smartening up...
