Old lever action identification

Not that it means anything, but the cartridges in that bandoleer are certainly not .44-40s, although that lever gun probably is. Perhaps he had a second rifle chambered for a rifle cartridge, or perhaps the bandoleer was a prop for the photo.
I think the carbine is probably a '73 . . .
The diagonal line behind the loading gate visible in the photo is absent on the Marlins.

We are trying to figure out who this ancestor is, and possibly date when this picture was taken. He has what looks to me like a Winchester Mdl 94, but there were a number of lever guns from that era that look similar, so I am not sure. Maybe it's a Henry 44-40? Old lever actions certainly aren't my area of expertise! This guy may have been in upper Canada but more likely had already headed west in this pic, in Wyoming or maybe even made it to BC by the time this pic was taken.
There, that's better. I'll go with the '73 crowd, and I think this was taken at a studio so the bandoleer probably is a prop.

Given the length of the cartridges & their apparent larger bore size, I think it's a Winchester Centennial, ie. Model '76 Saddle ring carbine in .40-60 W.C.F.

Apparently the guy in the photo was in the Cross family. AE Cross was one of the founders of the Calgary Stampede.

Tried to clean it up a bit. His fingers cover where the dust cover would be, and his other hand covers where the wood meets the end of the receiver Hard to judge. I agree with Leeper that the line is a scratch though.
I think what looks like six fingers is actually the flat on the '73 ahead of the loading gate.

It's most definitely not an 1892 or 1894, the lever hump makes that clear. Definitely not a 76 or 86 either, for obvious reasons. Definitely not a 93 Marlin as the trigger guard part of the lever on the rifle in the pic goes right into the hump and doesn't have the scallop the Marlin lever does.
I'm leaning towards 73, but there isn't any sign of the prominent side plate the 73 had... Which makes me think 66. It might just not show up due to the photo quality however.
