holy hell!!!! today i was out hunting in the a new area around some farms.
I saw that there were lots of deer in the area and would probley be a very good place to hunt.
I found a cleared area just past the edge of someones farm (saw the fence) so i start to set up a blind faceing away from the farm. I just get set up when two guys on atvs ride up to were im sitting. then they see me and start to scream at me and i mean scream (lots of swareing) they finaly come up to me and say that im on the the other guys feild i was like im sorry but there are no NO hunting signs, no fence around the perimiter exept the one behind me (i walked the field to find the best spot for the blind), and this is not a feild (there were stumps and cut trees everywere) then one of them grabs his guns from the gun boots and loads it up. he then tells me that I can leave now if YOU dont wont any trouble and then he stairs a hole trough me with his gun across his lap.
im like f*ck this and i leave.....
what should i do sould i call the cops or do nuthing i dont no....... :?

I think most hunters usually ask for permission to hunt on private land don't they ? I agree these guys were out of line and are you saying this guy had a hand gun ??...gun boot ( scabbard) , OK I get it ,
I was thinking "boot gun" :? . Still way out of line . If anyone threatens you with a gun for sure the law could get involved but sisnce you had no witness and were on private property about all the police would likely do is go talk to the owner and maybe give him a warning .

no it was a rifle but i was shure that i wasnt on any ones land like i sead no fences and no signs it was an open area with the closest house about a mile away.i would always ask permission if i new that i was on someones land. but i was also shure that they didnt wount me in there hunting spot thats why they did that.
it realy freeked me out is that was the people are like in my area??????

I don't know if land has to be fenced or posted to indicate it is owned by anyone . I guess maybe it's different out your way then here in SW Ontario as all farm land/bush is privately owned unless way the heck up north and Gov't land .

the bad news is that both parties are wrong. Land does not have to be fenced or posted to be owned and yes all hunters have to ask premission to hunt on land before they set up BLINDS with out permission. As for the land owners, they are wrong in what they did by bring a gun out there, but did you have a gun with you?
The land owner has the upper hand with the law as you were setting up a blind with out permission.
The best way to deal with this is to call your fish and wildlife guys and let them deal with the land owners and this should not hinder you from getting permission from other more friendly land owners to hunt on there land.
 
I would definatley call the cops. if you remeber about a year or 2 ago the Asian guy in Michigan I think killed and wounded a group of hunters because he was on there land or they were on his. we dont need another tragedy like that. CALL THE COPS AND MAKE A STATMENT
 
The first thing that you need to do is to obtain a landolwners map so you will know which property is privately owned.This will probably prevent such situations from ever occuring again.
 
Here in Ontario, if the land is not posted or fenced you cannot be charged for the first offense if you leave when asked to leave. In Eastern Ontario where we rifle hunt for deer this happens a lot, no fences, people end up walking onto other land, most people give the other hunter the benefit of the doubt. I would also be concerned about the grow op, I found some stumps of plants a few years back, you need to be careful.
 
Okay, so you made a stupid mistake.
You left, no biggy if you were honest about it.
However, NOBODY has a right to point a firearm at someone for these reasons!!
We are supposed to be using them for hunting , not assaulting another hunam being.

Were these guys even the landowners?

Yes , I would contact the police and make a statement, as well as the Game Warden.

The landowners were wrong in the use of a firearm to make a point... but with a house just a mile away it would not be unreasonable to go and knock on the door.
The onus is on us as hunters to find out where we are hunting... Crown land maps are easy to get... and everything else is privately owned :idea:
 
In BC the trespass laws are a bit different (I think most of the west is like this). If you didn't cross a fence or boundary - I do not think you were breaking the law. I might have gone to ask at the closest house but that doesn't really matter - they over reacted bigtime.

From p.12 of 2005/2006 BC Hunting & Trapping Synopsis

ACCESS RESTRICTIONS
Several laws govern public access to
wildlife and several types of closures specifically
limit access by licenced hunters or
others. In brief the following laws apply:

1. Trespass Act - The provincial Trespass Act sets
out strict limits on any public access to
enclosed private land. Private property is
considered enclosed if any one of the following
conditions are met:

- there are clearly visible signs prohibiting
trespassing posted at each ordinary access
point; or
- the property is surrounded by a lawful
fence; or
- the property is surrounded by a natural
boundary such as a river bank or a 4 1/2
foot hedge.
- In the Fraser Valley, and to a lesser extent
elsewhere in agricultural areas, local sporting
groups (clubs) have made private arrangements
with landowners to exclude other
hunters. Such areas are frequently posted to
no trespassing by these sporting groups.

2. Forest and Range Practices Act
(Section 58) Motorized recreation
regulation orders to restrict the use of
motorized recreation vehicles such as ATVs
and snowmobiles may be established in
various areas around the Province.These
areas are signed with information identifying
the type of motorized use that is restricted,
the area where the restriction applies and
the period of the year when the restriction is
in effect. In addition this information is
available at local Ministry of Forests district
offices.

3. Wildlife Act (Section 39) - A person is not
permitted to hunt on cultivated land or on
Crown land which is subject to a grazing lease
while the land is occupied by livestock, without
the consent of the owner, lessee or occupant
of the land.

In addition to the above, there is authority under
provisions of the Wildlife Act to limit access by
hunters or other persons. Relevant regulations
include the Motor Vehicle Prohibition Regulation
and the Public Access Prohibition Regulation.

To enter, hunt over or trap in
cultivated land, posted land or private
property without the owner’s
permission is committing an offence.
It is the responsibility of the hunter to
get permission from the land owner
before accessing private land.

I have met #######s like this while hunting on Crown Land.... trying to kick you off. You don't need this hassle.... It takes the fun out of nature and the hunt. You did the right thing and avoided a confrontation. These guys may be a little unstable... life is just too precious to risk getting unnecessarily hurt/killed.

Always, always get written permission and keep it on you. Write the land owner and thank them as well as give them details on who hunts with you and all contact info. Tell them that you will treat their property and all contents with care and respect.

Call the Police and report.... even if nothing comes of it.

Well here I KNOW that you HAVE to have at least markers and there HAS to be a NO hunting sign every 100 ft along your property and i just got off the phone with the Cops they said that there was nuthing they could do for me because I didnt get any names or stuff like that. I also asked about the fence thing and if i was alowed to hunt there he said that as far as he was conserned that I had every right to be there and even if they did own the land they needed to be at least visible markers around the area (there wasnt) like i sead befor i think they were just angry that i found there spot or as some of you have inplyed maby they do have a grow op or something all they would of had to do was ask me nicely to leave even if they were hunters i would have left but they came "gunz blazing".
and as for the the gun thing ya i had my rifle with me but it was 20ft away in its case with a trigger lock on it, i had not even got it out yet.
and the blind was a green tarp with a whole cut in it, thats it, i remove it and bring it with me when ever im hunting it is not like a perminet fixture.

well that is the next thing im going to do because i know about 500 yards away is a camp sight (with no people there)and i dont wont something like this to ever happen to me again

You would probably get a similar response from me had you been on my land. The difference would be that my rifle would probably have already been loaded. When kicking and armed individual off my property, I don't think it is unreasonable to be armed myself. If he pointed his gun at you, I think that would constitute a threat which would be way out of line. Tresspasers are scum and do not deserve a polite response. GET THE F*** OFF MY LAND NOW AND DON"T EVER COME BACK!!!! In my opinion you were totally in the wrong. It is your responsability to know where you are. FWIW, I don't grow dope and if you ask I'll usually let you hunt.

All that being said, I'm in Ontario and totally unaware of BC laws and ethics. :D
