Pinned SVT 40 Mag Question

I recently got an SVT 40 and was checking everything out to make sure it will be good to fire on the weekend. I was loading rounds into the magazine and could only fit in 4 7.62 x 54r buggers in it. The 'pin' is a little rivet on the back of the mag and it appears it was put in a few millimetres too high.

I would really like to be able to use all my allowed 5 rounds

Can I legally re-pin the mag myself a bit lower? If so, is this difficult to do? Or are there any better options? I would really like to shy away from further mutilation of the SVT magazine as well.

Legally if you put a new rivet in then drill out the current one it was still a 5 rounder the whole time.

I had one like that, but they caught the mistake. You can see an empty rivet hole a few mm's above the current rivet.
