possible issue with my new SW M&P 9?

If the top round is too high you would get this (Black followers have been replaced by Grey ones in new production,) I don't know if this is anything to do with that. If the slide lock doesn't allow you to slingshot with no magazine in, there's a spring issue. You may find some info on these issues at mp-pistol.com it's a good place for tech info etc.
 
I just purchased a brand new Smith & Wesson M&P40, and I experienced the same problem. From what I understand S&W had a problem with the magazine catch polymer being too soft. This causes the mag to blow out and completely screws up the timing/cycling of the gun when fired. Luckily, it's a simple fix, just replace the magazine catch with a new one. S&W is aware of this issue and has send replacement mag catches to most dealers already.
 
No, this problem (mag catch) occurs with older guns (and has been rectified in newer production) and isn't the same issue. I do believe that the M&P magazines are not properly handling full capacity, like a limited capacity mag on an AR that won't allow the bolt to close. Has the problem occured with 9 rounds in the mag?
