the M1 and M3 use the same inertia (spring) recoil system..the M4 uses a gas port recoil system...different guns...and the M4 meets the current requirements of a non-restricted gun.
FYI, the Beretta 1201P is "very similar" to the M1...it is not a prohib either.
Apparently it was a screw up of mega proportions back when they were deciding what to prohib and what not to prohib.
The only registered Benelli's at the time of course were "Evil" 14-inch, collapsable stock - M1/M3 Super 90's. Naturally "All Benelli's must become prohibited." :roll:
The law makers then realized after-the-fact that thousands of hunting variants existed that were not "evil" - so came the exemptions list for the Benelli line which can be found on the CFC website.
The M4 is totally fine as it meets all the non-restricted requirements (as it should).
All Benelli's use the same recoil operating system, except the M-4. It doesn't matter if it is the M1, M2, Super Black Eagle. You could take the bolt out and put it into any receiver.
