PSA - Firearms transfer notice no longer temp Reg Cert.

All those “can I take my restricted firearm to the range before my certificate arrives” threads settled.

I knew it. Glad I never waited for it before heading to the range.

Thought it was always like this..... transfer number just lets you pick up from post office.

Law clearly says you must carry the reg cert on you.

This.
I have never received anything via email besides the transfer notice or authorization to transport (when that was a thing) and it was nothing like the registration certificate. They are clearly 2 different things, at least in my experience in AB in at least 20 different occasions.
So I don't think this is anything new, just the arm of the law trying to clarify.....which they do so well, so often...

So your theory is you arent the holder of a registration certificate unless you literally have it on your person? In my opinion, which has never been proven wrong, as soon as I am issued a registration number I am the holder of a registration for the firearm in question

You interpret what you want. I am just posting the relevant sections of the Firearms Act and the Criminal Code.
When did you prove to be right? In court?

I agree with your opinion.

Nowhere does it say you have to have the certificate on your person or face criminal charges.

Maybe Runkle of the Bailey will make a video. :)

Where on the transfer notice does it say it is a temporary registration? If it only serves to take possession and go straight home why doesn't it say right on it? It seems, like everything else, that things are left open to interpretation.

Ya - I saw what you pasted just wondering if you had an opinion

I don't like to test the law often anymore as I have been witness and victim of overreach. I'd rather not go bankrupt through the courts.
In my opinion, it doesn't matter what anyone here thinks. Only the opinion of those who can charge you and the courts. People can do what they want, but if you run into the wrong LEO, it won't matter what you think.

true that - never hurts to err on the side of caution

When you think about it, taking possession and going straight home with only a transfer notice is actually illegal. Section 91 does not indicate a transfer notice.

The Transfer notice was put in place after they passed C-68 and they realized that it was one of the many screw ups in the Firearms Act.

I mean, if you have the will and the cash to settle things in court, have at it. I'll buy whiskey if you win as it'd set precedent for others. Unfortunately the average Canadian cannot afford their day(s) in court.

That's why we need to support the orgs and companies fighting for us.

If you present a registration number, attached to the registered firearm, written in a notice from the federal government, what grounds do they have to suggest a crime?

None, but they'll still arrest you for it and make you spend thousands of dollars in court fees to prove your innocence.

It would make far too much sense to have them email the reg certificate instead of the transfer notice.

I've never understood that part. For decades. They mail you a TAN with the registration number on it and then another letter with a certificate. Why not just a TAN and the certificate?

As forgoing to court to prove it, I don't think it's ever happened that someone was arrested for not having the reg cert on them and this system has been in place decades. Police can access the registry from their car I think.

I am just seconding from here in Alberta I thought this was always the norm for awhile now and was even told this on a reg I had go through about 2 weeks ago. The lady from the CFO told me with the registration confirmation she emailed me I could take the firearm to my residence but needed to wait for my new RPAL to take it to a range. Plus I honestly do not see this as much of an issue considering how quickly the new license came with the transport conditions anyways, was less than 5 business days. I hadn't even had time to go to the range before it arrived. Isn't this all significantly better than having a separate paper ATT, or even worse having to apply for a separate ATT every time you wanted to take restricted firearms anywhere? Idk this does not seem like something to be all that concerned over. There are bigger fish to fry.
