If you have a license, the birds are in season, and you take every bird your dog catches and kills as part of your limit, no legal issues. However, I would never tolerate that type of behavior from my dog.

I've been working with her , if she smells a rabbit or grouse , she tells me . it appears that if I ask her to fetch the grouse or rabbit she will .
I also have 100% recall with her too and she will stop what she is doing and come back to me no matter what .
The recall part is a major bonus. Pretty hard to break the the predatory impulse to catch the bird. Harley started out that way but he was very young and we got past that after a while. It is not impossible to train that out of your pup. One of my previous dogs loved to kill kittens. It was something we could not train out of him, he was kept close all the time as a result. Now if I could stop Harley from eating his own crap that would be a major success.
