Question about short barrel.

Just want to make sure about something. If you have lets say a 870 and the barrel is cut to 8.5 inch is it prohib ,if its a bought dlask 8.5 inch its legal ? Because i know someone who had one cut down right next to the pump that was seized by the Police and they're processing it as as a prohib firearm.
 
This is correct. If you cut down the barrel its illegal but if you buy it short its fine. If you are trying to make sense of it, you are trying to apply logic to a place where logic is not welcome
 
Depend on who's cutting the barrel, if you're cutting it then yes it's prohib if cut below 18".

It's legal if cut by a manufacturer.

Please tell us more about the gun seized and how it happen.

The details i can give you is the guy got in an accident flipped the truck in the ditch ,when he woke up he grabbed his rifle but forgot his shotgun in his truck, he walked 15km to a cabin to end the night, its a no cell service zone, and wait for day light to get help. Morning comes someone found the truck and went searching for someone in need of help. Cops were called they found truck seized gun ,guy wasn't present he was being "helicarried" out to hospital for serious injuries.

I just saw pictures of the shotty and right away i told the officer i wasnt sure he was right about it geing prohibited since it looked factory made he sight was on the end was crowned. Didnt talk to the owner yet but the officer is saying one week later that they are going forward with charges of possession of prohibited weapon.
 
I guess its not dlask, but if its made by a gunsmith does it work i think not but im just curious.

If it's a manufactured short barrel he'll beat the charge, if it's a cut down job he's f@cked.

Not a close freind but a coworker,still this sucks a lot. He ok now had a good concussion and face lacerations busted arm. Hes a freak to have walk 15 km in pitch black night with all of the injuries he had. Coppers are going ahead full force on this one. Ill try to find the case number when it comes out. Could be long before he sees court, only thing going for him is he's First Nation so could help for reducing the sentence.

Why would being native help him in sentencing?
 
Useally they try to reduce sentences for natives/inuits because of over crowded prisons they try to rehabilitate them outside in their communities instead and try to keep jail for harder crimes like murder and such.

The shotgun was a 870 90% sure because of pump and stock and what the bolt looked like.

If he's innocent of the charges as you say, why would he have to face sentencing?

I think OP isn't entirely sure one way or the other. Hes just looking for clarification. My guess would be its a cut barrel if the cops are going forward with prohib weapon charges, because it should be pretty easy to make the cops look really stupid if it wasn't... but who knows, baseless charges happen.
 
If it is 8.5 inches, the barrel wasn't cut. He would have had to replace the barrel ring too. And the gun would have to be bought as an 8.5, even if he just bought the receiver, but then he would have probably bought the barrel too. If it was 12", that is possible

It shouldn't. SHOULDN'T being the key word, but I do remember reading something here recently about some sort of skewing existing in the legal system due to... what I'm going to call political correctness.
