It's my understanding any rifle built originally to operate as a full auto is restricted. But anything one offed could be made non restricted, provided it has the proper barrel length, and, (I'm serious, I heard this) no carry handle. We shall see.
AR180B is probably what you're referring to, completely different design than the AR15, although the modern iteration uses AR15 trigger mechanism and mag well, it is so different to the AR15 that it can't be a "variant" of it, hence restricted, and it's also so different to the AR180 that it isn't a "variant" of IT either (prohibited), therefore it falls in between and end up non-restricted. It's a .223 btw.

is there an unrestricted AR-10? i was under the impression that they were all restricted. if there is an unrestricted AR can someone clarify the model plz?
AR's were restricted by name, they were going to go prohib but they are the civie version of the current service rifle thus the DCRA, et al had something to say about it, thus only restricted. BTW it is camo because REm is trying to convinve some of their customers it is a hunting rifle, same reason it has no sights and no flash hider.
If it is deemed an AR-15 variant, it cannot be non-restricted. This new Remington (built by Bushmaster - Cerberus owns both companies now) is most definitely an AR variant and thus it is restricted. If Dlask Arms couldn't get their PAC-5 pump-action AR look-alike to pass as non-restricted, a covering of Mossy Oak camo ain't gonna do it! There are no AR-10 rifles that are non-restricted. Flat tops, carry handles, etc...have no bearing on a rifle's classification.
