Restricted Firearm coming in mail - do i need an ATT to pick it up and bring it home

In my scenario (and it has happened) my girlfriend picked up the mail and I had no idea this was going on... So that's not illegal but if I knew it and told her that's on me?

So what would be the appropriate place to remove the firearm from the box, apply a trigger lock, and place it in a case? At the postal counter? On the way to the car? In your car?

As the law is written at the counter.

Yes, if she just picked up the mail there is no intent to commit an offense. If you told her to go get your package because you didn't want to get an ATT that is an offense.

What a joke.... I would love to see the look on the postal worker/shoppers employee's face when you pull out a pistol at their counter and attempt to apply a trigger lock while she screams bloody murder. Anybody want to be a guinea pig and try this out? It might lend to our cause to get the CFOs booted out.

Thats the thing, this is the part that is vague, not the requirement for an ATT. And really only an issue if you purchase from a bussiness as an indvidual would have been required to follow SOR/98-209 to get it to the post office. And as such would be a legal defense should somthing happen and it not be secured properly.

Actually, according to the laws of transportation:

The pistol would have to be encased and locked and trigger locked during transport to the post office.

It's once you get to the post office that you can take your trigger lock back. :eek:

I paid for a firearm and the store never gave me a tracking number what ever should I do? Maybe I should call them or email them and ask for one.

I see now you have run out of ways to rationalize your position to yourself so now you have to resort to calling me an anti. Its not my fault your poor arguments are so easy to prove wrong.

This is the first time I have purchased a restricted firearm from a person, not from a dealer or store. We completed the transfer with the CFC and the seller contacted the CFO and I assume got an ATT to put it in the mail? I received the registration for said firearm from the CFC and a letter from the CFO that they know I own the firearm. The firearm is now on its long meandering way through Canada Posts sorting department and may or may not make it here.

Question is: When it arrives at the post office, do I need to contact the CFO and ask for and ATT to pick it up and transport it home or is the ATT that was used to deliver it to the Post Office still in effect until I get it home?

I do not have a copy of the ATT. Once the gun was shipped and I received the tracking number for Canada Post the seller stopped replying to my emails.

If anyone could help that would be great. I would rather not have to call the CFO and talk to them if I do not have to.

Last time I got one in the mail I did not know what was in the package until I got home.
 
It's all BS...

Example... I used have a rural address and had a mailbox at the end of my driveway... Was I legal picking up a package there if it was a gun?

When they moved my box across the road.. Was it legal for me to pick-up a package at the box.. What if it was a restricted long rifle should leaning up against my box.. should it have sat there until I got the ATT?

My wife picks up the mail... If the package was a gun did she break some law?
Since Canada post tracking was non-existent where I was I honestly didn't know.. (it took 2 days for them delivery to be recorded)

PS they didn't get signatures.. They had a signature card on file that they scanned as a package passed thru the post office..

On occasion the driver would come up the drive if they didn't think she should leave the package or she wanted a coffee.. I'm guessing that was legal..

These days I can ship a gun from the house the carrier will pick it up and I therefore I don't need an ATT..


Now what If I'm not home and the postman drops a package off at home, my wife signs for that package and that package is an evil glock... Is my wife now breaking some law??

Here is the simple truth it's a package or it's not... When it's not a package it's a gun.. It's a catch 22 As I certainly won't go into the post office in a major centre, sign for a package, rip it open to verify it's locked and put a lock on it right there if need be... You all know what the outcome would be..

So it has to be a package until you get it home.. Otherwise you are breaking some law..

Do you get an ATT I guess that depends... do you know it's a gun?

The Canada post Corporation act says exactly when it is and it not just a package. And as soon as it hits your postal box or you pick it up it is no longer "mail".

Your right mens rea is your friend and it can be your enemy. Everyone with an RPAL knows it is illegal to transport a restriced firearm without an ATT, if you choose to do so you have proven mens rea of an offense.
