Run-in with MNR last night

For the guy charged for resting his bow or gun on the hood of the truck. I'd like to hear the other side of the story.

Funny thing is, I normally would too, but this particular employee is the one with the most honesty and integrity out of my entire staff. I have no issue believing 100% of what he tells me based on his work ethics.

Though I dont know what else they'll think of next.I'll bet McSquinty made millions in the last two years just on watercraft offences.I think I'll invest in one of them pullbehind suitcases so I can carry a copy of the firearm and boating regs.and ALL the paperwork you MUST have on your person.
 
Gota love the west. I don't even own a bow case. As well my bow sat up resting on the back window of my truck for the entire year last year. No issues... No harm.
 
Its odd how politicians and the law, trust gun owners in Western Canada.
You can drive around 24 hrs a day with youre rifle or shotgun uncased,... common sense prevails.

Maybe Ontario politicians fear for their own lives after dark, for all the stupid laws they make,.. to give them retarded liberals some sense of value to keep their well paid jobs I guess?.cou:

I can't say that I disagree with this- if I'm walking around at night (later than a half-hour after sunset), I don't want to be mistaken for game by someone who's illegally hunting at night. I acknowledge that it being after dark is in itself a regulation for not hunting, but for my safety, I don't want someone with an itchy trigger finger who can't tell me from a black bear (yeah, we're about the same size, and after a few days in the field smell the same) to put a kill shot into my lungs just because he can't see me.
sure it's far-fetched, but when it comes to not getting shot by accident, I'm okay with that.

So make it illegal to shoot at game 1/2 hour after sunset. As it is you can be charged for driving to an indoor archery range with an uncased bow in your trunk (MNR threatened to do this when I was 16).
Truck guns? better case them if driving somewhere "inhabited by game" (which, realistically, is just about everywhere, there are plenty of deer in suburbia).

It is illegal to shoot game after dark, unless you have a night hunting permit for raccoon. It's not likely to stop someone who feels they're being attacked by a bear, even though it's a person walking through the woods.

It's a circular argument- if it IS a bear, then you should have access to your gun quickly, but if it ISN'T a bear, you shouldn't.

Being in the latter category, I'd prefer the person walking back to camp after dark to have to work to get his shot off at me. My opinion, I'm sure there are just as many opposed, which are perfectly valid as well.
 
I'm actually very surprised a single guy, who has deep pockets and a love for hunting, hasn't challenged this law on its arbitrary nature (in contravention of the Charter.) Should actually be a slam-dunk, otherwise it'd be no different than a cop accusing you of drinking and driving because you have a 24 of beer in the backseat of your car...

Try and open a can on the backseat of your car, see what the cop has to say about it. The beer is the "firearm" in this case. If you can touch the firearm = it is not encased. Beer in cans = no worries.
That's how I see it.
 
The bow (or gun) is not loaded. That would be the quantifiable purpose of "intent". (Really, who wastes an open beer? :)) If I've got a round chambered, well, then it becomes more likely I'll use the firearm illegitimately. Like said, this would be pretty slam-dunk.

Again, the beer in your example is the firearm. The fiream has to be enclosed on all sides to be considered encased. In the case of beer, the can has to be open for the cop to charge you. In your example the beer is the firearm and the case (or gun sock) is the can itself.
 
I'd still try it on arbitrary grounds. Now whether the crown would pursue the case, well, that's an entirely different matter... :D



PS:

You're also failing to quantify that a gun un-encased is a regulatory offense, an open beer in your console is criminal.
