I wonder if head space is an issue here. I wonder if the action is not staying (or being) locked for the required time. If the action was not locking you would end up with a blowback action. You would have extraction before the pressure has dropped down to a safe level. If this were the situation then the back end of the case would be unsupported as it were extracted. The pressure would blow apart the weak exposed case.

Just a thought.

I had the same thing with a rifle. Would work ok for a few shots and then it was rip the case in half. This happened a few times and I thought it was a dirty chamber. So I cleaned it and was stupid enough to keep shooting it and had another case head blow off and I took part of the case head into my glasses. If I was not wearing glasses I would have lost an eye. Your barrel is set too far forward, making case stretch too much and with the result of ripping the case head out. Don't shoot the rifle, send it back and get a different one. Eyes are pretty important to be risking every time you pull the trigger.
 
Well, I extra cleaned the chamber today, in prep to try it tomorrow, but after all the feedback from you guys, I have decided its not worth trying, and will try calling S.I.R again Monday, and remind them that no where in their catalogue does it say milatary surplus is not warrantied, and that I was also assured by the woman on the phone I had 30 days to return it for exchange or refund which is the only reason I bought it through the mail.
Thanks again for all the feedback, and to Proutfoo for offering ammo, and also P.P who offered to meet up with me to have a look at it. I finally find an unissued SKS and its a crapper...Oh well....I'll keep lookin, and I'll keep ya all posted if S.I.R makes me a happy customer, I think they be idots not to give me my money back, and get ####ty advertising for something worth $165
 
Keep in mind, they're a lot more likely to offer you a swap than a total refund, and your chances of getting 2 duds in a row are slim to none. Don't give up on the SKS, they're awesome guns!

+1 on the don't give up on the SKS. It is an awesome little riffle.

That said, if you want your money back -like someone also said- be as nice as you have to be... AKA be diplomatic.
