S&W M&P 15-22 magazines - demand compensation

This is a thread concerning just one aspect of the 15-22 magazine issue - compensation.

I suggest that all 15-22 owners write to Public Safety Minister Vic Toews requesting compensation for the cost of their 25 rnd magazines. This was property acquired legally and in good faith. For the government to prohibit or confiscate it now without compensation is basically theft.

Smith & Wesson and firearms dealers are blameless in this matter and should not be expected to replace or exchange the magazines. The issue arises entirely from a retroactive (and highly questionable) classification decision by the CFC. I think there is a compelling case for government to partially remedy the situation by reimbursing owners.

Letters might also note that even though every 15-22 owner is recorded on the LGR the government has negligently failed to notify them of this decision, thereby placing them in jeopardy of criminal penalties.

I would also suggest sending copies of your letter to the local MP (or nearest CPC MP), any local CPC candidates (if one has been selected in your riding) and to whatever firearms advocacy organizations you belong to.

I have taken my own advice and have prepared a batch of letters to go out later today.
 
Have the powers that be actually taken any action with respect to these magazines?
Has any S&W owner received notification that his magazine must be surrendered?
Wouldn't demanding compensation be a bit premature if the authorities have yet to do anything about this interpretation?

The magazines are now prohibited devices. My rifle and mags were in the shop for warranty service when the decision was made. The dealer received a letter from the CFO advising them about this and instructing that no 25 rnd magazines were to be sold or returned to customers. So, in effect, they were confiscated by the Government of Canada.

If you still have the magazines you are now in possession of a prohibited device. I'm not aware of any owners being notified, I certainly wasn't. I presume they'd allow a grace period before charging someone, but that is really beside the point. You can't legally own or use them without risking criminal penalties, so you are out whatever they cost.
 
I would like to know if we will get instructions on what/how to deal with the Mags...?
I have not been contacted in anyway. Has anyone contacted the CFO ,and let them know they have destroyed/turned them in? I hate being in the dark! complete B.S!!
 
I was at P & D a week or two ago and they still had them for sale.

They'll probably be hearing from the Alberta CFO soon. I have a copy of the letter the BC CFO sent to the dealer. This is a direct quote:

"The twenty five shot (25 shot) cartridge magazine S&W product number 404850000 is a 'prohibited device.'"

The letter also says, "You may wish to liaise with the manufacturer to seek a solution to this situation (i.e. compensation for or replacement of the magazines.)"

I say any such compensation is entirely the responsibility of the Government of Canada, which created the situation on the flimsy basis of a S&W catalogue showing the "pistol" with a 25 rnd magazine.
 
Talking to the S&W rep Kelley Rathman they are not willing to exchange the magazines because, as quoted by Kelley

I was under the impression that now the magazines are to be turned in, and therefore would not be available for exchange.

How would we request a reference hearing?

I am in complete agreement with this. The situation would not exist if the government hadn't created it. To the best of my knowledge and from what I've seen in other threads, the pistols are not available, nobody knows if they will ever be made available and therefore their use in same is a contrived circumstance: a heavy handed "solution" to a non-existent "problem". But then, that is typical of most gun control policies.

Exactly so. The S&W warranty dealer told me the pistols are not available in Canada, though if that's because of Canadian or U.S. law or simply because no one has bothered to import them I don't know.

I certainly hope most owners write to Toews. Letters to politicians are usually of little use, but in this case the issue is clear and straightforward. If he denies compensation or stonewalls then people can make their own decision about his integrity and act accordingly. For me, this is a matter of principle and is non-negotiable.

This is also an issue that the gun orgs should be jumping all over. Property seized or prescribed, consequential decisions issued on the flimsiest of pretexts, citizens criminalized without notice or warning. This kind of stuff is worthy of a Hugo Chavez regime. I will be disappointed (though, frankly, not entirely surprised) if the orgs don't vigorously run with it.

Thanks for the link. Thank god they are pinned to 10 rounds. Canadian children can sleep safely in their beds once again.

No Canadian child should ever sleep soundly until they have an AR under their pillows loaded with 30 rounds and extra mags under the sheets, and they have been taught extensively how to use it. I am damn serious.
