I don't know what business you are in, but if I had a custom machine shop and made gears, I'd never sign a non-compete if that meant I couldn't work in my existing field. I doubt a contract that strips me of my right to earn a living could be enforced.

I can see agreements to not divulge trade secrets or copy a certain pattern, but even that has limits.

Firearms accessories (mostly magazine related stuff).... my agreement is to help protect us from the companies (machine shop, tool and die, injection moulding) we work with in development and manufacturing of our gear, not to sell or make our products to other interested parties. The last thing I want is one of the guys in the shop doing a run of one of our products and selling them to people out their back doors.

It happens...

From what I understand, non-competes have to be extremely specific and are almost impossible to enforce in most circumstances. I imagine they are fairly typical in most businesses, especially in a sales position. They will say something like you will not try to sell the exact same product to the exact same people, in which case it would be enforceable if you could prove it. Basically, exactly what PBR described.

So, yes, you are right in some aspects, they have their limits and can’t strip someone of their right to make a living. But, they can prevent you from leaving a company and straight up stealing the business and are a lot more typical than you seem to think.
 
If only they would go against the Chinese makers and North American sellers of knock-off crap... Optics, rails, stocks, laser and lights.
 
I just got off the phone with Samson (wont give a name) but they said they are operating in full force and there was never a bankruptcy claim, Troy tried to sue them with a design conflict which was never used by troy and they got pissed because Samson decided to go into business for themselves...

All well i have been ordering direct from them for a long time and always get my stuff
 
I wanted an EVO rail and One Shot was not responding to my emails. I ordered direct for Samson and had it in less than two weeks for the same price. Spoke with someone at Samson about installing it on my HERA upper and they were great to deal with. I swapped out a Troy Vtac. My Sampson is WAY nicer. I will continue to support Samson and thier product line. Great stuff and service.
