SCAR Where Art Thou ?

I have to say this really blows, the fact you guys paid for this rifle like how long ago now?
Scrapping the gun registry is not enough guys...
 
Well in about another month it will be a year, with no updates?:mad: or even where this might be headed:confused:.I'll be making a decision either way in the near future.:kickInTheNuts::kickInTheNuts:

We have had no further contact from RCMP or FN on this file. Our communications asking for an update have gone un answered.

We are again consulting with our lawyers to see if there is any legal recourse but there appears to be nothing in the legislation that sets any time standard for CFC/RCMP to meet and until they actually issue a decision/classification there is nothing in the legislation that allows us to challenge their decision.

Our options are quite limited but we do what we can...

I'm sure you would like nothing better than to be shipping my rifle to me, after all thats the business your in.

Sure they can do something... they can fix this and a whole bunch of other problems everyone is having by making amendments to the Firearms Act... changes that would clarify issues like what a "Variant" is, put time limits on reviews and classifications, create proper methods of challenging questionable rulings and basically clarifying all the "grey areas" currently causing everyone so much trouble.

Unfortunately having an MP simply send an "inquiry" to the RCMP doesn't force them (or encourage them) to do anything except stop all work on active files and spend time and energy to respond to the "inquiry"... they generate mounds of paper explaining what they have done to-date and where things sit currently... MP's can't bring pressure to speed up the process or clarify legal interpretations by sending inquries to RCMP. They need to create and pass legislation that mandates those changes and then the RCMP have no alternative but to obey the law.

Fire them. They are not earning their pay when they don't do their job, and waste time in paperwork dodges and asskissing Liberals.

Crap rolls downhill... the grunts on the ground aren't the problem, it's the people overseeing them, running the various departments, who are the problem and need to be tuned-up.

Many of the actual people doing the hands-on work in that department are very good and in some cases even "pro-gun" or at least not "anti-gun".

Higher ups... not so much.

The grunts simply do what they are told... whether they like it or not... agree with it or not... that's the way it is. They are not where the blame lies.

That's been my experience anyway...

Probably true. I suppose they never question those political orders, though. During the Civil War an officer on a horse said, "Burn that town down." Somebody carried the torch.

I dont have the article in front of me right now, but I recall Dave Tomlinson (DAT) of the NFA mentioning that there is some obscure legislation that requires a civil servant to deliver whatever to the rightful owner in a timely manner (not sure of the official language), and if they stall, they can face up to a 14 year sentence.

Maybe contact the NFA and see if someone there can sift through the old newsletters.

It's Section 337 of the Criminal Code of Canada - Servant Refusing to Deliver.

I'm not sure it applies since it requires the public servant to turn over property to a person authorized to demand it and who does demand it.

The offence is committed when the public servant fails or refuses to turn over the property after the demand.

What is the property you are going to demand? Is an FRT # property? Isn't it the property of the Government of Canada, Since the RCMP is the creator of the FRT #?

How do you prove Questar or anyone else is authorised to demand the FRT #?

writ of mandamus....I used it on smg/mg registrations in 1978. But, you need...Big Money to make it work and a lawyer who works for justice for your case.

Call 1-800-731-4000 ext:1090 and ask for an update on the the FRT of the SCAR16s... That extension goes right to the testing lab, and I'm sure after about 20-30 calls a day it might motivate them. When I called "Mike" answered and said it wasn't uncommon for something like this to take over a year as they are very busy with inspections. I asked " what is a reasonable time, 2 years?" he answered that it should never take that long. It's within your rights to call these guys "daily if necessary" until they get the job done.

Just my idea....
