838.1 The PURCHASER must be registered under Canada's Controlled Goods Program (CGP). Proof of the PURCHASER'S CGP license will be required in order to complete the sale.

The PURCHASER acknowledges that the controlled goods indicated on the bill of sales are subject to the Defence Production Act (DPA) and the Controlled Goods Regulations (CGR), that the exportation of these goods is subject to the controls of the Export and Import Permit Act (IEPA), and that any controlled goods of U.S.-origin are subject to the U.S. International Traffic in Arms Regulations (ITAR). Should the PURCHASER choose to transfer US-origin controlled goods to a third party within or outside of Canada, the PURCHASER must seek the prior approval to do so from authorities. The PURCHASER understands that exports from Canada require the prior approval of the Export Controls Division of the Canadian Department of Foreign Affairs and International Trade, except for most exports to the U.S.A.
The PURCHASER understands the controls imposed on these assets remains in effect until they are totally destroyed in such a manner that the cartridge case is inoperable and can no longer be utilized as designed. Acceptable mutilation methods are: by cutting, crushing, smelting or other means that renders them unusable for their originally intended purpose(s), in which the preferred method is smelting. The PUCHASER agrees to destroy the cartridge casings within six (6) months of the date on the Bill of Sale. When the assets are destroyed, the PURCHASER shall maintain a record that details the destruction process and who destroyed them for a period of at least five (5) years for audit purposes.
Should the PURCHASER agree to transfer the controlled goods in Canada for the purpose of destruction, as set out above, the PURCHASER shall bind the person or company who the controlled goods were transferred to by those same terms and conditions by providing that person or company with a copy of the above clauses, obtain the signature of that person and keep a copy on file for a period of at least five (5) years for audit purposes.
The PURCHASER acknowledges that a failure to adhere to these restrictions may result in criminal prosecution, fines and imprisonment.
The materials listed may contain items of an explosive or flammable nature. The purchaser shall accept full responsibility for damage to property, personal injuries or loss of life that may result from handling or processing, and shall indemnify and save harmless Canada from and against all claims or demands in respect of such injuries or loss.
