The CFP cannot appeal the ruling, that would be up to the Crown in right of Ontario. This was a quasi-criminal case. The province prosecutes criminal proceedings. Its up to Ontario.

While reference hearings are held before a provincial court judge that does not make it a provincial matter. And Philippe Alma (lawyer for the CFP) is federal so the Ontario Crown has nothing to do with it. And I believe the time to appeal is 30 days. (was when I did) It caused a bit of confusion in my case since the court clerks were trying to determine if the appeal should be held in a federal court. In the end it goes to the next higher court of the province.

July 30, 2009. I believe they have 30 days to appeal.

No, because it's not a linear argument. 12(5) abolishment has nothing to do with this ruling. I was going more for the free thinking judge angle. If the judge is willing to see logic in the laws, then maybe we'll see other parts of the firearms laws re-examined and pulled apart. The begining of the end for tyrannical gun control by the RCMP/CFC if you will.

When its classified as a non restricted 22 then it goes into rimfire.

The current Conservative Government is highly unlikely to order an OIC. They're well aware that a large chunk of their fundraising dollars comes from gun owners. That said, if the Liberals get in, or the CPC has a political makeover before their next term at the helm, it would likely be foolish to not expect more OICs. But that's then, and this is now
