The CFP cannot appeal the ruling, that would be up to the Crown in right of Ontario. This was a quasi-criminal case. The province prosecutes criminal proceedings. Its up to Ontario.
While reference hearings are held before a provincial court judge that does not make it a provincial matter. And Philippe Alma (lawyer for the CFP) is federal so the Ontario Crown has nothing to do with it. And I believe the time to appeal is 30 days. (was when I did) It caused a bit of confusion in my case since the court clerks were trying to determine if the appeal should be held in a federal court. In the end it goes to the next higher court of the province.
