SKS magazine capacity

I was wondering why I can only put 4 cartridges in the magazine +1 in the chamber, so 5. The legal magazine limitation is supposed to be 5. So how come I can't put 5 and hot load to 6? Is it legal to modify the magazine so I can put 5? Or it's a weird rule made just for the SKS, like the Garand and the 8 rounds?

5 should go in the mag
 
M1shooter, are they new mags? Sometimes I find the newer the mag, the harder it is to get the last round in. Also, are they pinned mags? If they are, they may have been pinned incorrectly so not enough space.

I'm guessing it's a Russian Frankenpin job? If so then it's down to shoddy workmanship. You should be able to thumb in 5 with the top of the 5th sitting right @ the top of the magazine. I'm guessing that if you have 5 shells on a stripper, the first 4 go in and the 5th sits loose in the action? You need to grind down the pin in the magazine as it's not letting the follower get down far enough to take the 5th shell.

Sometimes they have to be shimmed up as they choke on the 6th shell in a stripper.
 
My chinese military would take 5 and had enough room to push down the top round and close the bolt on an empty chamber. It would stand to reason that you could file the pin down a bit so long as it wont take 6, but it may strip 6 off the clip.
