Just get fast at sticking 5 shells into a tube magazine. It only takes a few seconds. And you run a shotgun differently than you run a rifle or anything with a detachable mag. If you find yourself firing a couple rounds then needing to move you load a couple more when you can

Depending on who saw what, denying having it in hand could possibly be an issue. Whereas loaded or not is far far harder to prove. All hypothetical of course.
